MTNUTES <br />City Council <br />Diovember 25, 1981 <br />The Attorney suggested that the Council could inform Granada Homes that <br />if they do not extend the letter of credit, the Council will submit a <br />claim against it. <br />Mr. Fahey suggested that the City attach the uihole letter of credit on <br />December 8th, if the letter of credit is not extended. Fahey stated <br />that the Engineer and Mr. Forsberg should inspect the ditch and give <br />the builder the necessary directions for completing the work. <br />The Engineer informed the Council that the ditch is not straight because <br />some trees were avoided so they would not have to be removed. <br />Mr. Forsberg felt that the swail was a poor job, but there was nothing <br />e1se that could be done. <br />Mrs. Sca1ze stated that Mr. Lunders claims that he has II feet of property <br />that he cannot use because ~t is located beyond the swail. Lunders also <br />stated that the swail was not within the easement. <br />Mr. Fahey suggested thatthe Engineer determine if the ditch is within the <br />easement. <br />Mr. Carley stated that in some cases he is sure the swail is not with~n <br />the easement. The swa91 was moved in order to not disturb some trees. <br />Mr. Carley stated that the swail is not a ditch, but just a slop~ng of <br />the property. <br />Mr. Forsberg questioned how the City will get Mr. Garske to comply with <br />what the City wants regarding the swail. The Engineer stated that he sent <br />a letter to Garske and Mr. Garske replie~ that he would comply, but to date <br />has not. P4r, forsberg suggeste~ that another letter be sent to G~rske <br />instructing him to put an addition of the swail on his property to the <br />south. Forsberg stated that the stakes are in, it is just a matter of <br />putting the swail in. <br />Mr. Fahey stated that the letter of credit indicates that drafts must <br />be presented after a ten day notice to the bank. If that is the case, <br />the City would have to notify the bank on the 27th or 28th that ~he City <br />will be making a claim against the letter of credit. Drafts would ha.ve <br />to be presented by the $th of December. <br />Mr. forsberg stated that the Fngineer and Flttorney will have to submit <br />an invoice for their time on the project. Mr. Forsberg also stated that <br />the job done by the builder on the swail was not satisfactory. <br />The Engineer felt the job was satisfactory. Mr. Carley also stated that <br />all the pipes are in. <br />The Attorney stated that notification to the bank of a pending claim against <br />the letter of credit need not specify the amount of the claim. <br />Mr. Fahey stated that if the Engineer can inspect the work on Friday <br />and if it is O.K., the default need only be for the amount of fees <br />of the Attorney and Engineer. <br />Page -5- <br />
