MIPIUTES <br />City Council <br />Plovember 25, 1981 <br />The Engineer stated that everyone agreed not to take trees out and, <br />therefore, the swail waivers a little bit. <br />Mr. Fahey was concerned that the swail may run outside the easement <br />area. Mrs. Scalze commented thai: if that was the case, the property <br />owners could fill the swail in the future. <br />The Engineer commented that the City originally wanted a 20 foot easement, <br />but the property nwners did not like that and, therefore, the City then <br />cut the easement back to 10 feet. <br />Mr. Forsberg commented that in developments in the future, the Council <br />should make sure that all drainage issues are taken care of. <br />Mrs. Sca1ze commented that if the easement is on 10 feet of the back <br />property, that is where the swail should have gone. Mrs. Scalze commented <br />that the City should not trespass on people's property to avoid taking out <br />trees. <br />Mr. forsberg stated that if the street had not been raised and the lots had <br />not been filled there would not have been a drainage problem in the area. <br />The Attorney commented thai; Mr. Lunders has a water problem in his basement <br />and Mr. Lunders does not feel the swail will take a lot of his water. <br />The Flttorney also commented that the easements are all ?_0 foot easements <br />except for two evhich are 10 feet. <br />Mr. Parks also commented that the swail ~s in, but restoration work has not <br />been done. There are groovesfrom the tires of the machinery and the <br />property has not been reseeded. <br />Mr. Fahey felt that the builder should put the property back in the same <br />condition it was when the vaork was started. Mrs. Scalze felt this could <br />be made a part of the default notice. <br />The Flttorney and Engineer agreed. <br />Mr. Fahey introcluced the following resolution and moved its adoption: <br />RESOLUTION N0. 81-11-663 - INSTRUCTING THE CITY ATTORNEY <br />TO SFND A NOTICE Of DEFAULT TO TNE BAMK CLFlIMING TNF $7,500 <br />OF GRANADA FIOMES ON THE BASIS ThIAT TFIE DRAIDIAGE.
