MIPIUTES City Council Plovember 25, 1981 The Engineer stated that everyone agreed not to take trees out and, therefore, the swail waivers a little bit. Mr. Fahey was concerned that the swail may run outside the easement area. Mrs. Scalze commented thai: if that was the case, the property owners could fill the swail in the future. The Engineer commented that the City originally wanted a 20 foot easement, but the property nwners did not like that and, therefore, the City then cut the easement back to 10 feet. Mr. Forsberg commented that in developments in the future, the Council should make sure that all drainage issues are taken care of. Mrs. Sca1ze commented that if the easement is on 10 feet of the back property, that is where the swail should have gone. Mrs. Scalze commented that the City should not trespass on people's property to avoid taking out trees. Mr. forsberg stated that if the street had not been raised and the lots had not been filled there would not have been a drainage problem in the area. The Attorney commented thai; Mr. Lunders has a water problem in his basement and Mr. Lunders does not feel the swail will take a lot of his water. The Flttorney also commented that the easements are all ?_0 foot easements except for two evhich are 10 feet. Mr. Parks also commented that the swail ~s in, but restoration work has not been done. There are groovesfrom the tires of the machinery and the property has not been reseeded. Mr. Fahey felt that the builder should put the property back in the same condition it was when the vaork was started. Mrs. Scalze felt this could be made a part of the default notice. The Flttorney and Engineer agreed. Mr. Fahey introcluced the following resolution and moved its adoption: RESOLUTION N0. 81-11-663 - INSTRUCTING THE CITY ATTORNEY TO SFND A NOTICE Of DEFAULT TO TNE BAMK CLFlIMING TNF $7,500 OF GRANADA FIOMES ON THE BASIS ThIAT TFIE DRAIDIAGE. SWAIL IS NOT SATISFFlCTORILY COMPLETED IDI SO FAR AS NOT ALL AREAS OF THE SWAIL ARE WITHIN 7HE EASEMENT, GRADING FlND SEEDING IS NOT COMPLETED FlND SU6JECT TO ANY FURTHER DEFECTS TFIAT MFlY BE DISCOVERED UPON INSPECTION, AND FURTHER SUBJECT TO OFFSETTIPlG FOR CTTY FlTTORNEY AND CITY ENGINEER FEES TNAT HAVE TO BE COMPUTFQ The foregoing resolution was duly seconded by Mrs. Scalze. ~yes (5) I"ahey, Scalze, Flanson, Nardini, Forsberg.
