MINUTES <br />City Council <br />~Iovember 25, 1981 <br />Mr. Kelbe was also concerned that he was in the City Center a month ago <br />and was never informed at that time that there was a problem. <br />Mr. Hanson asked Mr. Kelbe his intentions on the property. Mr. Ke1be <br />stated that after the cabin is no longer used by his aunt he intended <br />to either use the cabin as a guest house or possibly a boat house. <br />Mr. Hanson stated that in the event of Mrs. Kelbe's death, Mr. Kelbe <br />would have a piece of property that is not served by a road. <br />Mrs. Nardini pointed out that Mr. Nadeau has been instructed that when <br />the house on his property becomes vacant, the house must be torn down. <br />Mr. Fahey stated that he would like to see the original plans that were <br />presented to the Bui1ding Inspector. Mrs. Nardini commented that it was <br />obvious that the Ruilding Inspector did not look at the plans. <br />Mr. Kelbe informed the Council that his basement is already in. Mrs. <br />Nardini commented that Mr. Kelbe was informed to stop construct~ion before <br />the excavation was comp1eted. Mrs. Nardini informed the Counc~i1 that she <br />explained the City's position to Mr. Kelbe at that time and suggested <br />that he stop construction. Nardini also suggested that Kelbe see the City <br />Planner, which he did not do. <br />Mr. Fahey commented that g9ven the facts that the Building Inspector <br />issued a permit the City should enter into an agreement with Mr. Kelbe <br />that upon the death of Mrs. Kelbe the cabin should be removed or <br />removed in such a way so that a lot split of the property would conform <br />to City ordinances. If the above is not done, the City could remove <br />the cabin and assess the cost against the property. <br />Mrs. Scalze suggested that Mr. Kelbe should be given six months to <br />comply with ttie Council's wishes after Mrs. Kelbe no longer uses the <br />cabin. <br />Mr. Parks suggested that Mr. Kelbe be ordered to get an addendum to the <br />lease agreement he has with Mrs. Kelbe that in the event she is permanently <br />r~esiding in a nursing home the above could be done. P4rs, Kelbe would be <br />asked to terminate the lease in the event she was residing in a nursing <br />home. P1r. Parks stated, that Mr. Kelbe should be given a reasonab1e amount <br />of time to either remove the cabin or move the cabin. <br />Mr. Kelbe asked if he removed the p1umbing from the cabir~ if he would be <br />allowed to use it as a boat house. Mr. Fahey suggested that if the cabin <br />were gutted, Mr. Kelbe could probably apply for a conditional use permit <br />to use the cabin as a boat house. <br />The Flttorney stated that Mr. Ke1be would have to comply with the City's <br />current zoning ordinance. <br />Mr. Fahey introduced the following resolution and move~ its adoption: <br />Page -8- <br />
