KELP,E EN7ER IPITO FlN <br />AGREEMENT TO BE PREPARED BY THE CITY FlTTORNEY THAT WTLL PROVIDE THAT <br />THE COTTAGE NOW ON THE PROPERTY AND NOW NON-CONFORMING UNDER CTTY <br />ORDINANCE BE ALLOWED TO REMAIN AS A VARIANCE TO TFIE ORDINANCE <br />UNTIL MRS. KELBE DIFS, IS PERMANENTLY A RE.SIQENT IN A NURSING <br />HOME OR OTHERWISE CEASES TO BE A PERMANEN7 RESIDENT OF LITTLE <br />CANADFl AND AT THAT TTME MR. KELBF LITHER REMOVE THE COTT~GE <br />WITHIN A REASONFlBLE PERIOD OF TIME NQT TO EXCEED SIX MONTHS OR <br />SUBDIVIDE THE PROPERTY THE COTTAGE IS BUILT ON AND REPOSITION <br />THE COTTAGE ON THE SUBDIVIDED LOT SO THAT IT COPfFORMS WITFI TFIE <br />CITY'S ORDINANCE EXISTING FlT THFl1' TIMF AND IF MR. KELBE fATLS <br />TO DO EITHER OF THESE THINGS, THE CITY MAY REMOVE THE COTTAGE <br />AND ASSESS FlNY COST OF ~OING SO AGAINST THE PROPERTY <br />The foregoing resolution was du1y seconded by Mrs. Scalze. <br />qyes (5) Fahey, Scalze, Hanson, hardini, Forsberg. <br />Nayes (0). <br />Resolution declared adopted. <br />This resolution appears in Resolution Book No. 7, Page 433. <br />McDonald's The City Planner reported that McDonald's has complied with a11 requests <br />Matter of the City. The Planner stated that he will send a letter to McDonald's <br />thanking them for their cooperation. <br />St. Jude's The Planner reported that he has reviewed the St. Jude's PUD Agreement <br />PUD and has discussed it with the Attorney an~ it appears to be in order and ade- <br />quate for the City. <br />The Attorney stated that the only thing the City needs is a site plan <br />showing the 100 foot buffer zone. S~. Jude's is doing this and the City <br />should have the site plan shortly. <br />The Flttorney stated that the agreement is ready for signing by the Mayor <br />and the City Clerk. St. Jude's has already signed the agreement. <br />The Attorney a1so reported that St. <br />Mrs. Scalze presented the check for <br />Clerk. <br />Jude's has paid their park charge. <br />St. Jude's park charge to the City <br />Mrs. Nardini introduced the following reso1ution and moved its adoption: <br />RESOLUTION N0. 81-11-666 - APPROVING THE ST, JUDE'S <br />PUD AGREEMENT <br />The foregoing resolution was duly seconded by Mr, Hanson, <br />qyes (4) Nardini, Hanson, Fahey, Scalze. <br />Nayes (0). <br />Mr. Forsberg was not present. <br />7he foregoing resolution appears in Resolution Book No, 7, Page 434. <br />Page -9- <br />
