MrnuT~s <br />City Council <br />December 9, 1981 <br />Mr. Fahey introduced the following resolution and moved its adoption: <br />RESOLUTION N0. 81-12-691 - ADOPTING THE FlDDENDUM TO <br />THE SHERIFF S CONTR CT WITFI THE OUTLINED ADDITIOM <br />The foregoing resolution was duly seconded by Mrs. Scalze. <br />Ayes (5) fahey, Scalze, Fianson, Nardini, Forsberg. <br />Nayes (0). <br />Resolution declared adopted. <br />This resolution appears in ~esolution Book No. 7, Page 472. <br />Pha1en Mr. Parks reported that he has researched the idea of charging bacl< <br />Overflaw costs for sewer charges against State and County for Phalen overfloH~. <br />Parks reported that the Constitution prevents the City from assessing <br />the State Highway Department for any local improvement. Hpwever, <br />the 4latershed District can assess the State. Mr. Parks commented that <br />it has never been done, but the City could tr,y to assess the State for the <br />overflow that belongs rightly to them. Mr. Parks stated that he researched <br />this and there does not appear to be a case on it. <br />Mr. Parks stated that it might be worth looking into further. <br />Mrs. Nardini si:ated that the City could try this, and other cities might <br />follow suit. <br />Mr. Parks stated that Little Canada has a different situation because <br />most of the City is cut up by highway. Mr. Parks stated that he would <br />research the matter further. <br />The C1erk asked how many acres of highway and water works property the <br />City has. The Engineer stated that he would 1ook up this information. <br />Machins Mr. Parks stated that he has spoken with the Machins about a permanent <br />Easement easement on their property. Mr. Machin would like some topography maps <br />of his property so he could get an idea of what his lancl looks like. <br />There is some high ground and he would not want this to become landlocked. <br />Mr. Parks sugc~ested that the Engineer provide Mr. Machin with these. <br />The C1erk reported that some 1969 Council meeting minutes indicate that <br />the City did approve a drainage easement on the property. <br />Mr. Parks stated that he would check Mr. Fred Memmer's files, the City <br />Flt~orney in 1969, to see if he can finci some information on this drainage <br />easement. <br />6illboards The Flttorney sta.ted he will review the Supreme C,ourt ciecision on billboards. <br />The Supreme Court made a decision on an ordinance where all bi1lboards are <br />banned. It was a very far reaching ordinance and was, therefore, declared <br />unconstitutional. <br />Page -15- <br />
