MINUTES <br />City Council <br />December 9, 1981 <br />Mr. Parks stated that when he receives this decision, he will review <br />it to be sure that it does not have any effect on the City's ordinance. <br />Mr. Hanson stated that the City's ordinance says all bi1lboards must <br />come down in 5 years. Hanson asked if the City would have to pay damages <br />for causing them to come down. <br />The Planner stated that in a case> Naegele vs. Minnetonka, the court <br />said that it was reasonable to amortize a non-conforming use. Over~ a <br />period of time the value can be amortized and it is reasonable to request <br />the use be removed. The Planner stated that this case might be worth <br />looking into. <br />Mrs. Nardin~ thought the bil1boards were put up with a certain number <br />of years limitation. Hanson and Scalze replied that this was not so. <br />Kelbe Mr. Parks stated that he de1ivered the agreement the Counci1 asked him <br />Flgreement to prepare to Mr. Kelbe several days ago. The Flttorney also asked that <br />Mr. Kelbe give him an addendum to his lease with Mrs Kelbe stating that <br />the 1ease wou1d be void if she went permanently into a nursing home. <br />This stipulation was put into the agreement the Flttorney drew up. However, <br />it was fiound that the lease already had that addendum. <br />Therefore, the Attorney will reciraw the contract leaving this stipulation <br />out. <br />The Attorney also informed the Council that Mr. Kelbe would 1ike to know <br />if the City would give any consideration to the cabin being used as a <br />boat house. Kelbe stated that he would make any structure changes <br />necessary. The Flttorney stated that he informed Mr. Kelbe if the City <br />would be willing to do this, they would require him to have the structure <br />conform to the City ordinance in effect at the time. <br />Mr. Fahey stated that he saw no problem with thrs. <br />Mrs. Scalze asked if the boat house would come under shoretand regulations. <br />The Planner stated that there would be restrictions on what is a boat <br />house under these regu1a~ions. The Planner stated that this ordinance <br />will be coming before the Council shortly. <br />Mary House Mrs. Scalze asked the Flttorney if he had contacted Chuck Cody regarding <br />the timer on the lights at the skating rink. The Attorney sta.ted that <br />he talked to Mr. Cody, and Mr. Cody will be talking to the ladies at <br />Mary Flouse regarding this. <br />Maplewood The Engineer stated that he would go over the City's costs regarding <br />Sewer Maplewood sewer connection and then he would speak to P1aplewood on this. <br />Connection The Engineer felt the City should enter into a Joint Powers Flgreement on <br />this. The Engineer stated that he would report back to the Council <br />on this. <br />Page -16- <br />
