MINUTES <br />City Council <br />December 9, 1981 <br />Mrs. Nardini felt that a 6 month review should be placed on this matter. <br />Mr. Fahey commented that the written agreement could include a stipulation <br />that the next home that goes up for sale coutd be required to be removed <br />from the park. Mr. Husnicl< statecl that under the 7aw he could not do <br />this. <br />Mr. Fahey suggested that the Attorney could investigate th~s and find <br />out if there is a legal way to do it. <br />Mrs. Scalze again stated her positinn that she was in favor of the road <br />going in one of the predesignated 1ocations. <br />Mr. Fahey introduced the following resolution and moved its adoption: <br />RESOLUTTON N0. 81-12-685 - DEFERRING CONSTRUCTIOM OF THF <br />EXIT FROM THE NORTH STFlR ESTATES TR~TLER COURT TO SOUTH <br />OWASSO AT TNIS TIME CONTIMGFNT UPOPI MR. FRAN FIUSNICK ENTERING <br />IMTO A 4~RITTEN AGREEMENT WITH 7HE CITY THAT WOIILD ALLOW FUTURE <br />CONSTRUCI'IOI~I OF A ROAD OVER LOT 119 WITH THE UNDERSTANDING <br />THAT THE ROAD NOT BE CONSTRUCTED UPlTIL MR. HUSNICK IS ABLE <br />TO MOVE MRS. BREEDTNG TO ANOTNER LOT IN TFIE TRAILER COURT <br />AND FURTHER THAT MR. HUSNICK AGREES TO MAKE 7NE FIRST VFlCANT <br />LO7 IN THE TRAILER COURT AVAILABLE TO MRS. BREEDIPIG FlND SUBJECT <br />TO ThIE CITY FlTTORNEY REVIEWIPIG TFIE LEGALITY OF MR. HUSMICK'S <br />REQUIRING SOMEONE WHO IS SELLING HIS TRFlILER IN TFIE TRAILER <br />COURT TO RFMOVE THE TRAILER AND MAKE TNE LOT AVAILABLF FOR <br />MRS. BREEDING FlMD FURTHER DECLFlRING THAT THE LETTER MR. HUSPlICK <br />SENT TO MRS. BREEDING OFfERING 70 RELOCATE HER TRFlILER SUBJECT <br />TO HI5 EXPENSE BE MADE A PART OF THIS AGREEMENT AND FURTHER <br />DECLARING 7NFlT TFIIS AGREEMENT SHOULD BE FINALIZED FlND RETURNED <br />TO THE CITY COUNCIL WITHIN 60 DAYS <br />The foregoing resolution was duly seconded by Mr. Flanson. <br />qyes (4) Fahey, Hanson, Nardini, Forsberg. <br />Nayes (1) Scalze. <br />Resolution declared adopted. <br />This resolution appears in Resolution Book No. 7, Page 468. <br />Mr. forsberg commentedthat the Council is looking at the health and welfare <br />of 213 families. <br />The Attorney informed Mr. Husnick that his letter is not a binding <br />instrumerrt and that is the reason for this agreement. P4r. Parks also <br />stated that a11 Mr. Husnick's partners would have to sign the agreemerrt. <br />Mr. Hanson also stated that it was the intent of the Council that this <br />matter not drag on. Mr. Fahey stated that the residents of the park cou1d <br />advise the Council if a vacancy became open on the court. <br />The City Clerk stated that a hearing has been set for the 23rd of December <br />on the improvement of this road. It is recommended that the hearing be <br />cancel1ed, unti1 such time as the lot becomes vacant and a road can be <br />put in. <br />Page -8- <br />
