Husnick that when the road is put in it wou7d <br />be at his expense as ~t is being put in on private property. <br />Mr. Flanson introduced the following reso1ution and moved its adoption: <br />RESCLUTION N0. 81-12-6II6 - CANCELLING THE PU6LIC HEFlRING QN <br />ROAD IMPROVEMENT N0. 82-3 SCHEDULFD FOR DECEMBER 23, 1981 <br />The foregoing reso1ution was duly seconded by Mrs. Nardini. <br />qyes (5) Hanson, Nardini, Sca7ze, Forsberg, Fahey. <br />Nayes (O). <br />Resolution declared adop~ed. <br />This resolution appears in Resolution Book No. 7, Page 469. <br />Mr. Garske The City Clerk commented that the City has the easements from Mr. Garske <br />for the swail. The Clerk asked who was going to put the swail in. <br />The Engineer stated that he talked to Mr. Garsl<e, but he did not send <br />him a 1etter on it. <br />Mrs. Nardini asked what the City is going to do in this situation. Nardini <br />pointed out that the City has the option that provides for a certificate <br />of occupancy. <br />The Planner stated that he did not think the City has been issuing these. <br />However, some government loans require a certificate of occupancy. <br />Mr. Fahey asked if this provision shou7d be made stronger. The Planner <br />suggested that the City onty had to enforce this provision. <br />P4r. Forsberg stated that he is willing to wait until the Spring for Garske <br />to install the swa~il. <br />Mr. Fahey stated that in reviewing the ordinance he does not think the <br />certificate of occupancy can be held hostage for other things not connected <br />with the actual bui1ding. Fahey suggested that the ordinance be amended <br />so that alt aspects of the bui1ding must be satisfactory before the <br />certificate is issued. <br />Mr. Forsberg stated that the certificate shou1d not be issued until <br />drainage and landscaping are taken care of. Mr. Parks stated that a <br />building could be completed on December 15 and landscaping and drainage <br />could not be completed until Spring. Forsberg stated that in a case <br />like that e bond could be posted. <br />Mr. Parks stated that he never before heard of the requirement oF a <br />certificate of occupancy on a sing1e family home. Fahey stated that it <br />is required under the City's ordinance. <br />Mr. Fahey suggested that perhaps this subject should be discussed at a <br />workshop session. <br />Page -9- <br />
