MINUTES <br />City Counc:il <br />May 26, 1982 <br />Rental The foregoing resolution was duly seconded by Mrs. Nardini. <br />tLa11s (Cont.) Ayes (5) Fahey, Nardini, Hanson, Scalae, Forsberg. <br />Nayes (0). <br />Resolution declared adopted. <br />This resolution appears in Resolution ~ook No. 8, Page 239. <br />Mrs. Nardini stated Chat she asked the ACCOrney if the Council did <br />not like someone if they could take a liquor license away for Chat <br />reason. The Attorney stated that the Council would have to have <br />legaLLy justifiable r.easons to talce away a liquor license or a <br />conditional use permit. Fahey staCed that he agreed. <br />Mr. rahey stated that perhaps the Council could i.ncorporate in <br />the approval that Mr. ~rinkman would have to comply wiCh the things <br />set forth i.n the liquor ordinance and other ordinances of the City. <br />Fahey stated that the C~ity should have some identifiable standard For <br />how Mr. Br~inkman is to run his business. <br />Mr. Hanson stated that with the amount of money Mr. Brinkman wi11 <br />have invested this wi11 be a good enough incent~ive to run a good <br />business. <br />Mr. Fahey stated that he is sure Mr. Brinkman will run a fine ha11, but <br />he could se11 it someone el.se. <br />Mrs. Scalze asked what Che Council wanted to do under 9 of ~he Planner's <br />report. <br />Mr. Arinkman stated that if Che occasion warrants, he would like to <br />se1.1 wine and beer. <br />The Planner suggested that 9 could contain a more general statement that <br />Brinkman conform to the State and City regulations. Niel.son suggested <br />that the Attorney review these ordinances. <br />Mrs. Scalze asked what wi11 happen if the Attorney finds out that <br />Mr. IIrinkman cannot sell liquor because of the location of the church. <br />Mr. Fahey stated that he was no[ in favor of Brinkman selling liquor. <br />The PLanner stated that a liquor establishment must be 450 feet from a <br />church and 1,050 feet from a school. <br />Mr. Brinkman stated that he is just asking for approval of the ha11 <br />tonight. <br />Mrs. Nardini asked if Brinkman was willing to go along with the <br />one year review and perhaps a review every three years aLter the <br />first year as the Council cannot take away the permit at its whim. <br />Mr. Brinkman stated that this would be a~reeable to him. <br />Fahey stated that he did not feel the three year review was necessary <br />but just a general statement regarding compliance with the ordinances. <br />Page -10- <br />
