MINUTES <br />CiCy Council <br />May 26, 1982 <br />Rental The Planner suggested that the provision could state that the <br />Hall (Cont.) property conf.orm to State and City regulations in terms of liquor.. <br />Mr. Brinkman expressed concern with number 11 of the PLanner's <br />report which states that the rental ha11 be reviewed annuaLLy. <br />Mr.. Brinkman was concerned that if the Council changed, Che new <br />Council might not like the idea oF a renC11 ha11 and not renew <br />the permit. Brinkman stated that with a r.ental ha11, it is usuaLly <br />booked up a year ahead of time. <br />Mrs. Scalze stated that traditionally the Council has not denied <br />permits. <br />Mr. Fahey stated that the Council needs this control over. the <br />operation. Brinkman stated thaC he felt the Council would have <br />control with just a 3.2 beer license. <br />Mrs. Nardini aslced Mr. Brinkman if that is what he wanted was a 3.2 <br />beer license. <br />The City CLerk staCed that a Li.cense would be needed if there was <br />the sale of. liquor going on. Mr. Fahey stated that the State i.ssues <br />set-up permits and unless the Council had the one-year review <br />provision, the City wouLd not have any control. <br />The Planner staCed that under a condi.tional use permit when a timc <br />Limit is imposed, the time li.mit for review is set so that any <br />investment that had been made would be amortized within the period <br />of review. The annual review was suggested because it protecl-s the <br />City. The Planner suggested that a review could be made after the <br />first year and then perhaps every three or four years. <br />Mr. Fahey stated that he was willing to have ll striken if there was <br />some sort of general statement that the permit could be revoked it <br />the applicant failed to comply with the other provisions in the <br />PLanner's report and the ordinances of the Ci.ty. <br />Mr. Porsberg stated that he saw nothing wrong with the provisions as is. <br />Mr. Hanson suggested the rental ha11 in the RB district as a permitted <br />use rather than a conditional use.
