MINUTGS <br />City Council <br />May 26, 1982 <br />Rental Fahey stated that he was not prepared to vote on Liquor licenses <br />Hal1 (Cont.) tonight. <br />The PLanner stated that Section 921.030 E says a condiC~ional use <br />permit can be revoked f.or failure to compLy with the ordinances <br />of the City. <br />Mrs. Nardini suggested that 9 state that if alcoholic beverages <br />are served they must comply with State and liquor laws. <br />The Attorney stated that the liquor license would apply to only <br />intoxicating liquor. <br />The City C1erk suggested that the Attorney review the whole question <br />and advise the Council. <br />Fahey suggested that 9 say the sale of alcoholi.c beverages is prohibited, <br />however, if alchohol.ic beverages are served, Mr. Brinkman must comply <br />with State and 1oca1 ordinances. <br />The City C1erk stated that Brinkman may be able to get a wine license <br />if he is a restaurant. The Attorney commented that he did not - <br />Chink Mr. Brinkman could get a wine license because of the various <br />regulati.ons that must be met by a restaurant. <br />Mr. Fahey introduced the following resolutior. and moved its adoption: <br />RESOLUTION N0. 82-5-288 - AUTFIORI7.ING THE CITY <br />ATTORNEY TO PREPARE A'LONING ORDINANCE AMENDMENT <br />ALLOWING RENTAL HALLS IN AN RB AREA INCORPORATING <br />IN THAT ZONING ORUINANCE AMENDMENT THE RECOMML'NDATIONS <br />CONTAINED IN THE PLANNER'S REPORT UATED MAY 6, 1982 <br />WITH TEIE DELETION OF PARAGKAPH 30 AND CHANGING <br />PARAGRAPt-I 3 UNDER SF.CTION 909.040 TO PROVIDE OFF <br />STREET PARKING AT A RATE OP O~E SPACE POR EVERY <br />40 SQUARG FEE'L OF HALL SPACE FOR RECEPTION USE <br />AND FURTHER PROVIDED THAT IF THE IiALL IS USED FOR <br />AUDI20RIUM PURPOSES THAT TkIG OCCUPANCY BE LIMITED <br />TO THREE SEATS FOR EVERY ONE PARKING SPACE AND WITH <br />THE FURTHER PKOVISION THAT PARAGRAPH 9 IS AMENDED <br />TO READ THAT THE SPRVING OF ALCOHOLIC BEVF.RAGES <br />ON THE PREMISES SHALL BE PERMITTFD PROVIDED THAT <br />THE HALL COMPLY WITH STATE AND LOCAL ORDINANCES <br />ANU FINALLY STRIKING PARAGRAPH 11 IN I'PS ENTIRETY <br />The foregoing resolution was duly seconded by Mr. Forsberg. <br />Ayes (4) Fahey, Forsber.g, Nardini., Hanson. <br />Nayes (L) Scalze. <br />ResoluCion declared adopCed. <br />This resolution appears in Resolution Book No. 8, Page 240. <br />Mrs. Scalze stated that she opposed the rezoning as she had problems <br />with amending ordinances to fit a particular business and fel.t that <br />the business shoul.d fit the ordinance, not the other way around. <br />Page -11- <br />
