MINUTES <br />City Council <br />May 26, 1982 <br />Gervais Creek <br />Office nldg. <br />PUD (ConC.) <br />Mr. Forsber~ stated that he agreed. <br />With regard to the trails, Mayor Hanson stated that he did not think <br />the City wanted to own some 1andlocked property. Hanson commented <br />that the City should work out an easement agreement. <br />Mrs. Scalze suggested that Mr. Krejci meet with the Park Commission. <br />Betty White commented that the tennis court is not used that much <br />by City residents. <br />Mrs. Scalze commented that the City has an agreement that the tennis <br />court can by used by citizens in exchange for lawn care. Mr. Fahey <br />stated Chat it could be that citizens do not know that the tennis <br />cour.t is available for their use. ScaLze repli.ed that the use of <br />the tennis court has not been advertised. <br />Mr. Fahey suggested that the Council approve the concept conlingent <br />upon the park land dedication fee being resolved. Mrs. Scalze again <br />pointed out that the recommendation of the Park Commission is that <br />either cash or land be obtained in accordance with the provisions <br />of the ordinance. <br />Mr. Hanson asked what was done with MGM's fee. Mrs. Scalze replied <br />that the appraiser valued the property and the resulting fee would <br />have been $36,000. However, this fee was negotiated and MGM agreed <br />to pay $12,500 for the fisst half of the development. <br />Hanson asked if MGM's fee was negotiated, why can't this fee be <br />negotiated. Mrs. Scalze commented that the City must enforce its <br />ordinances. <br />Hanson suggested that the PUll be approved subject to Mr. Krejci's <br />meeting with the Parlc Commission and working Che fee out. <br />Mr. Nielson explained that the Council is bei.ng requested to give <br />concept approval for the PUD which is intended to give Mr. Krejci <br />assurance that the Council is in favor of the project. Nielson <br />expl.ained that the City staff would prepare a draft of the development <br />agreement. <br />Mrs. Nardini introduced the following resoluCion and moved its adoption: <br />RESOLUTION N0. 82-5-289 - CLOSING THE PUBLIC <br />HL~ARING ON TIIE GEKVAIS CREEK OFFICE BUILDING PUD <br />The foregoi.ng resol.ution was duly seconded by Mr. Hanson. <br />Ayes (5) Nardini, Flanson, Scala.e, Fahey, Forsberg. <br />Nayes (0). <br />Resolution declared adopted. <br />This resolution appears in Resolution Boolc No. 8, Page 241 <br />Page -1"3- <br />
