MINUTES <br />City Council <br />May 26, 1982 <br />Jespersen Mr. Fahey suggesCed that the Council first discuss the drainage issue. <br />P1at (Cont.) <br />Mr. Jespersen stated that the drainage for his property is the same <br />as on the west side of Payne Avenue. Jespersen stated thaC there <br />wi11 be a swail in the back yards from the fi1.1 that wi11 be bro~ght <br />in to put around the houses. Jespersen proposed that the swail extend <br />down to the proposed A11en Avenue and from there Co Yayne Avenue to <br />connect with the storm sewer. <br />Mr. Forsberg introduced the following resoluCion and moved iCS adoption: <br />RESOLUTION N0. 82-5-292 - CLOSING THE YUBLIC <br />HEARING ON THE JESPERSEN PRELIMINARY PLAT <br />The foregoing resolution was duly seconded by Mr. Fahey. <br />Ayes (5) Forsberg, Hanson, Fahey, Scalze, Nardini. <br />~ayes (0). <br />Resolution declared adopted. <br />This resoLution appears in Resolution Book No. 8, Page 244. <br />Mrs. Scalze stated that she has calculated that with the amount of <br />property involved, the Jespersen's park charge would be 6% of the fair <br />market value of. the property. The City Clerlc stated that the appraiser <br />set the value of each of the Jespersen's lots at $13,500. <br />Mr. Porsberg stated that he feLt the park charge should be $300 per home <br />for a total of $2,400. <br />Mr. Pahey stated that he agreed and commented thaC the Park Commission <br />has negotiated these fees with others. Pahey stated that he did not <br />think the Council shouLd ask the Jespersens to pay more than $300 <br />per home as across the str.eet on Payne Avenue that is a11 those homes <br />had to pay. <br />Mr.s. Scalze stated that the ordinance in effect is basicall.y the same <br />one that has been in effect since 1977. Mr. Jespersen asked if the <br />ordinance did not say Chat enforcement was at the option of the Council. <br />Mr. Hanson read part of the ordinance. <br />Mr. Forsberg stated that he felt the $2,400 would be acceptable, as <br />this is what was charged for the rest of Payne Avenue and for Mr. <br />Holzchud. <br />Mr. Fahey stated that the Council. only had the option ot enforcing <br />the ordinance wich payment in either cash or 1and. 'Lhis is what <br />is stated in the ordinance. <br />Mrs. Jespersen asked if the Council when considering the value of <br />the property tookalso into consideration the amount of assessments <br />on that property.
