MINUTrS <br />CiCy Council. <br />August 11, 1982 <br />R& S Road The foregoing resolul-ion was duly seconded by Mr. Hanson. <br />Proposal Ayes (4) Nardi.ni~ I-lanson, Pahey, Porsberg. <br />(Cont.) Nayes (0). <br /> Resolution declared adopted. <br /> This resolution appears in Resolution Boolc No. 8, Page 350. <br />Ilusnick Mrs. Nardini informecl the Council L-hat she spolce with a partner ot <br />Matter Mr. ltusniclc's and was informed that he ~aill. not be abLe to attend <br /> tonight's meetin~ as he is out of town ancl is not able to travel <br />Agenda due to an injury. <br />Item No, 5 <br /> Mr. Hanson su~gested that the matter be pos tponed until next month. <br />Neamy Matter 'Lhe City Clerk reported thac he has not heard any thi.ng f.uxther <br />Lrom Mrs. Neamy. <br />Agenda <br />Item No. 6 <br />Deluxe The City Attorney r.eported that the Letters the Council has on the <br />Construction Deluxe Construction situation are self-explanatory. Mr. Sweeney <br />stated that Deluxe must be served with a Prelimi.nary Notice of Intent <br />Agenda to Default 10 days beLore default. <br />Item No. 7 <br />Mr. Sweeney reported Chat he met with the surety and Deluxe and a <br />contractor that was interested in completin~ the project. Other <br />issues came up at the meeti.ng about. bills in dispute between Deluxe <br />and the subcontractors. <br />P4r. Sweeney reported tliat at this point the sur.ety wi11 put the <br />project out for. bid. The, obligation rests with the surety at this <br />point. <br />Tiling Of Mr.. Sweeney r.eported that [here is a problem wi.th filing the easemenC <br />liasement for. Improvement No< 81-5 on the property owned by the General Electric <br />Imp. 81-5 Pension Trust. Mr. Sweeney stated that it will talce about 5 to 10 <br />hours to get this accomplished. The General L'Lectri.c lacayers wi11 <br />Agenda be providing necessary documents. <br />T.tem No. 8 <br />The Attorney stated that if the easement is not filed it ~ai.l1 not be <br />enforceable on subsequent property o~oners unless the easement is <br />filed at the ti.me the property is so?d. Th9s could be somewhat <br />ri.slcy for the City~ in that the City may fail to get the easeme,nt <br />fi.le at the time of transfer. <br />Page -4- <br />
