MINUTES <br />Council Meeting <br />June 22, 1983 <br />Hageman Mr. Hanson opened the public hearing concerning the request from <br />Variance Mr. G1enn Hageman, 2444 McMenemy Rd., for a rear yard set bac]< <br />variance to construct a swimminq pool three feet from the rear <br />lot line. <br />Mr. Chlebeck spoke for Mr. Hageman who was unable to attend the <br />meeting. He explained that Mr. Haqeman is requesting a variance <br />for a swimming pool in his rear yard 6 feet from the garage and <br />three feet from his rear 1ot line. The City Ordinance states <br />that a pool shall be 10 feet to any lot line, therefore, Mr. <br />Hageman would need a 7 foot variance. The St. Paul Water Works <br />is located directly behind him and NSP has an easement on the <br />property that has never been recorded by the Court House. <br />There was no one present objecting to the variance. <br />Mrs. Nardini introduced the following resolution and moved its <br />adoption: <br />RESOLUTION NO. 83-6-257 - CLOSING <br />THE PUBLIC HEARING ON THE GLENN <br />HAGEMAN 7 FOOT REAR YARD SET BACK <br />VARIANCE TO CONSTRUCT A SWIMMING <br />POOL. <br />The foregoing resolution was duly seconded by Mr. Forsberg. <br />Ayes (5) Hanson, Fahey, Forsberg, Scalze and Nardini. <br />Nayes (0). <br />Resolution declared adopted. <br />This resolution appears in Resolution Book No. 9, Paqe 300. <br />Mrs. Scalze questioned whether the uniqueness of the lot was a <br />hardship case. The Council dsicussed the placement of the pool <br />in another area of the property. Mr. Locke recommended that <br />he was in favor of the variance. <br />Mr. Fahey introduced the following resolution and moved its <br />adoption: <br />RESOLUTION NO. 53-6-258 - APPROVING THE <br />VARIANCE REQUESTED BY MR. HAGEMAN ON <br />THE GROUNDS THAT SPECIAL CONDITIONS IN <br />A TOPOGRAPHICAL CHARACTERISTIC OF HIS <br />LOT AND THE ADJACENT WATERWORKS PROPERTY <br />AND THE LITERAL INTERPRETATION OF THIS <br />PART OF THE ORDINANCF WOULD DEPRIVE HIM <br />OF THE PRIVILEGE OF OTHFR PROPERTIES IN <br />THE SAME DZSTRICT, THAT IS THE POOL IN <br />HIS BACK YARD AREA IN A USABLE FASHION <br />AND THAT A GENUINE HARDSHIP EXISTS. <br />'i'he foregoinq resolution was duly seconded by Mr. Forsberg. <br />Ayes (4) Hanson, Fahey, Forsberg, Nardini. <br />Nayes (~).
