MINUTES <br />Ci.ty Cotmcil <br />Oct. 26, 1983 <br />TesC Mr. Fahey askec3 again why this ~vould give the City more control. The <br />Amendment Planner replied that under a vari.ance certain cr.iteria must be met. <br />(Conte) The Ci.ty coulcl be challenged under a variance. Once a variance is <br /> granted it i.s di.f.ficult to say no to other requests• Under. a <br /> Conditi.onal Use Permit the City has a stronger legal posi.Lion to <br /> say ~ohat it wants. <br />The City Attorney agreed. <br />Mr. Forsberg i.ntroduced the follo~aing resolution and moved its adoption: <br />RESOLUTION N0. II3-LO-507 - CLOSING THE PUf1LIC <br />IIEARING ON TH~ PROPOSED 'iT,XT AM~NDMSNT TO <br />SrCTION f3 OP TIi~ ZONING CODE <br />The foregoing r.esoLution was duly seconded by Mrs. Scalze. <br />Ayes (5) Forsberg, Scalze, Ilanson, Porsberg, Nardini. <br />Nayes (0). <br />Resoluti.on declared adoPted. <br />This resolution appears in Resolution 13ook No. 9, Pa~e 552. <br />Mr.s. Scalze introduced the following resolution and moved its adoption: <br />RF.SOLUTION N0. II3-10-508 - AUTtIORIZING Tf1I; <br />PLANNER TO PREPARE AN ORDINANCE AMENDING THIi <br />ZONING CODE GOV~RNING CONVENIENC~ GAS/GROCERY/ <br />P'OOD ESTAI3LISHMENTS <br />The Loregoin~ resolution was duly seconded by Mr. Porsberg. <br />Ayes (5) Scalze, Porsberg, Fahey, Nardini, Hanson. <br />Nayes (0). <br />Resolution cteclared adopted. <br />This resolution appears in 12esol.ution 13ook No. 9, Page 553. <br />Peclc Concept The Clerlc reported that Mr. Peck will be befor.e the Council in <br />Approval November requesting preli.minary and final pLat approval. <br />Agenda Mrs, Scalze reported that the Parks Commissi.on has recommended <br />Item No< 9 that the City talce property in lieu of cash for a park charge, <br />Mrs. Nardini stated that Mr. Peck expr.essed an interest in this. <br />ScaLze stated that the Par.lcs Commissi.on Lelt that the City should <br />talce the property and then negoti.ate with NSY. <br />Mr. Forsberg pointed out that the property would come off the tax <br />rolls. Scalze did not feel that the proper.ty generated much tax <br />revenue as it caas located under the NSP lines. <br />Pahey stated that he had no problem with thr concept as Long as <br />only one dupl.ex caas proposed. <br />Page -1.0- <br />
