MINiITPS <br />City Counci.l <br />March 14, t984 <br />Vacation Of. no sense to leave the other end open. <br />La(ce Street <br />(Cont.) Mrs. Scalze pointed out that Mrs. Malaslce has not requested the <br />vacation. The City Clerlc reported that he spoke with Mrs. Malasl<e's <br />attorney and i.nformed him that should the street be vacated, Mrs. <br />Malaske wi11 receive half of it. T.he Cl.erk stated that the Attorney <br />did not i.ndicate whether Mrs. Malaske was opposed to the vacation <br />or not. <br />Mr. Flanson aslced the status of the title of Che propertye The Clerk <br />repli.ed that the Attorney i.ndicated that this is being resolved. <br />hlr. Donald Behr asked why the Ci.ty was going to vacate the street <br />at this time. Mrs. Nardini. replied that the City was followi.ng <br />through with previous discussi.on with Mr. T3ehr on this matter. <br />Mr. E3ehr stated that he was not ~ainin~ anything by the vacation. <br />i~ehr requested that i£ the street is vacated that he be granted a <br />f.ill permit, a deed for the property, and that the property be <br />surveyed. Behr pointed out that he i.s bei.ng assessed for property <br />that he does not own. <br />Mr. I3ehr stated that he would not vacate the street as it is a <br />commerci.al area and could be an outlet for Parlc Street. <br />Mr. Pahey pointed out that the cost of putting Lake Street ~~n is too <br />hi.gh. <br />f3ehr stated that the property is low and there is a catch basi.n on <br />it. <br />Mr. rahey staCed that the reason the City i.s vacati.ng the property <br />is to get the assessment covered. Fahey stated that the property <br />would be of some benefit to Mr. I3ehr as he would own it. <br />Mr. Hanson asked how many yards of fi.l1 would be necessary. Mr. <br />I3ehr stated Chat he did not Icnow. <br />Mr. i'ahey stated that he did not feel the City should retain a <br />road easement for a street the k;ngzneer says is not feasi.ble to put <br />in. <br />Nardini poi.nted out that the City simply has a road easement over <br />the pro~erty. <br />Mr.. Hanson aslced i.E Mr. l~ehr. cou7.d appeal the assessment. The Attorney <br />replied that the appeal time has run. <br />The Engineer stated that he will replace the property lines in the <br />area. <br />Page -3- <br />
