The City has decided <br /> to purchase the groperty, so that decision has been made. <br /> The Flttorney suggested that he bring a resolut9on to the Council to <br /> start condernnation nroceedings. The Attorney felt that the City has <br /> to force the issue at this point. <br /> Fah~y asked the costs of condemnation. The Flttorney rehlied that there <br /> would be a hearing and court appraisal costs. 7here may be about $3,000 <br /> in commissioners' fees< <br /> Scalze asl<ed. if the previous condemnation e~ill have any effect on this <br /> proceeding. 7he Attorney did not feel that it vaould be admissable. <br /> y pointed out that the prop2rty is for sale and the City is just <br />Fahe <br /> . <br />having trouble getting the property owners around to terms. Scalze <br /> pointed out that there is the property o4•mers' asking price. Scalze <br /> asked if the cost deterinined uncfer condemnation could be higher than <br /> the asking pr9ce. The Attorney replied that it could. <br /> The Attorney felt that the Cit.y avou1ci stitl be able to r.ome to some agree- <br /> ment wi th P1r.Johnson. <br /> P9r. Collova stated that he was not in favor of contl.emnation at this <br /> point. Fahey sugyestetl that the City c~ive the matter until the December <br /> 11 Council meeting. In the meantime, the City uaould try to reach an <br /> agreement vuith Johnson and try to contact P~rs. i1osted or her realtor. <br /> The C,ity Attorney reported that Mr. Glanzer believes that the property <br /> owners should put up their oe~m fences. The Johnson fence aaould be to <br /> screan from Johnson's industrial yard and a different type of fence <br /> would be needed. <br /> P~r, alesener felt that the area should not be fenced until a need is <br /> demonstrated. <br /> The Attorney reported that Johnson wants a10,00~ per acre. 7he {lttorney <br /> fe1t that the City shoutd offer the $10,000 per acre, but Johnson <br /> wou1d hava to pay for his oE~m fence.
