MINUTES <br />City Council <br />May 13, 1986 <br />Concern was expressed about the filling that has been done in the <br />area. The Engineer reported that any filling that has been done <br />was with the approval of the City, DNR, and the Watershed. <br />The Engineer stated that it is possible that some of the property <br />in the area that has already been developed, would not be allowed <br />to develop under today's regulations. However, the necessary permits <br />were granted when this property developed some years ago. <br />Earl Van Norman of Greenbrier Circle felt that some of these permits <br />should not have been granted and felt that some property has been <br />developed at the expense of the rest of the City. Van Norman felt <br />that the cost of the proposed improvements should go on a public <br />referendum. <br />Fahey indicated that the present Council has been sensitive to the <br />issue of filling and any permits that have been granted have had <br />the approval of the DNR, Watershed, and Army Corps of Engineers. <br />Fahey also pointed out that because a project is presented tonight, <br />does not mean that the project will be put in. The City Council is <br />trying to develop a plan for the entire City. Fahey also felt that <br />when a particular project is being consider the Council will have <br />another meeting with the neighbors in the particular area. <br />Mr. Hamin reported that he has been trying to get approval to finish <br />a filling project he began 40 years ago and cannot get the necessary <br />permits. Hamin wanted to point out that fill permits are not just <br />handed out, but are subject to close inspection. <br />One member of the audience felt that the Morrison Avenue area adequately <br />drained. <br />Mr. Fahey pointed out that it was the opinion of the City's Engineer <br />that this improvement was necessary and also pointed out that City <br />staff has received a great many complaints in this area. <br />The next priority 1 project was Centerville Road & DeSoto Street, <br />partial Branch Ditch 76-82 and LaBOre Road to 400 feet north. <br />The audience pointed out that this area receives water from the freeway. <br />The Engineer reported that the City is aware of this and will try to <br />get State as well as County participation in the cost of this project. <br />The audience asked if there would be participation from surrounding <br />cities that drain into Gervais. <br />Fahey replied that unfortunately the City is the dumping area for <br />drainage from a lot of the northern suburbs. The City has no taxing <br />jurisdiction over these areas. <br />Slim Frattalone pointed out that Ditch 1~ needs to be cleaned. <br />Page -3- <br />
