MINUTES <br />City Council <br />July 23, 1986 <br />Frank The City Planner submitted a report dated July 22, 1986 which <br />Frattalone states that Anderson Landscaping and Prescription Landscaping <br />Property On are non-conforming businesses under the City's zoning of the <br />Park Street Frattalone property on Park Street. The report also outlines <br />various corrections that should be made to the condition of the <br />Agenda property. <br />Item No. 19 <br />The City Attorney reported that the letter that Mr. Frattalone <br />sent to St. Paul Utilities and Hoggheim Excavating states that <br />if they do not vacate the premises by September 1, 1986, the <br />City would revoke their business licenses. The Attorney pointed <br />out that Mr. Frattalone was instructed by the Council to send a <br />letter to these businesses terminating their lease agreements <br />with him. A similar letter was also sent by Frattalone to <br />Ted Ready Repair. <br />It was the concensus of the Council that since Anderson Landscaping <br />and Prescription Landscaping are non-conforming businesses, they, <br />too, should vacate the premises. <br />Mr. Collova suggested that these two businesses be given until <br />October 1 to relocate, as they have not received prior notice. <br />Council also discussed the fact that when Anderson Landscaping <br />received its business license, it misrepresented the type of <br />business that it would be doing, and reported that it was a <br />lawn-care business, while the Planner has determined it to be <br />a landscaping business. <br />Mark Schultz, property owner on Park Street, felt that all the <br />non-conforming businesses should be out by September 1 and pointed <br />out that new businesses have moved in the premises since the Council <br />first started discussing this problem with Mr. Frattalone. <br />Mr. Qlesener introduced the following resolution and moved its adoption: <br />RESOLUTION N0. 86-7-337 - INSTRUCTING THE <br />CITY ATTORNEY TO WRITE A LETTER TO FRANK <br />FRATTALONE ADVISING HIM THAT HIS PREVIOUS NOTICES <br />TO ST. PAUL UTILITIES, NOGGHEIM EXCAVATING AND <br />TED READY REPAIR WERE INADEQUATE AND THAT <br />NOTICES TERMINATING NIS LEASE AGREEMENT WITH <br />THESE BUSINESSES SHOULD BE SENT TO ANDERSON <br />LANDSCAPING AND PRESCRIPTION LANDSCAPING AS <br />WELL, TNE LEASE AGREEMENTS TO BE TERMINATED <br />EFFECTIVE SEPTEMBER l, 1986 <br />The foregoing resolution was duly seconded by Mrs. Scalze. <br />Ayes (2) Scalze, Nardini. <br />Nays (3) Blesener, Collova, Fahey. <br />Resolution denied. <br />This resolution appears in Resolution Book No. 15, Pages 394 and 395. <br />Page -16- <br />
