Financing (Cont,) F~hey asked if the City siiould proceed to designate the area ;.s tax increment, E3rixius recommended that the City not do so at this time as there w~ould be costs incurred b,y the City ~,~ithout a source for reimbursement, E3rixius reported that his office is anticipating that taxable bonds w911 be popular after the September 1 legislative changes conie into affect, Schletty Residents of Sch1etty t-loods appeared before the Council 2x pressing ldoode% concern about possible sale of a portion of Outlot A as a building si te. Agenda Addition P4r. Fahey outlined the history of Sch7etty 4l oods for those on the Council vaho u~ere unfamiliar ~d?th it. In the Fall of 1978, Mr. Fred Schletty originally platted Schletty ldoods, At that time Tracts l~, 3, C, and D!a~ere not included in the plat as huildab3e lots but were part of the outlot. Outlot 11 was shoa~n as a drainage easen~ent. In P9ay, 1979, F-1r. Sch1etty requested the resubdivision of Tracts A, B, C, and D to be carved out of Outlot A due to tne omission of these tracts from the plat as an error on the part of ~4r. Schletty's engi neer, Thi s evas approved by the Ci ty Counci 1. lio~riever, the question arose as to vlhether there yvas notice given to the neighbors on the matter> The conclusion was that the Council did approve Tracts A, t3, C, and D in P9ay of 1979, but Mr. Schletty never filed the tracts and thus the action became null and void. The neighbors have taken the position that P4r. Schletty informed them that Tracts A, ~3, C, and D v~roulci remain part of Outlot !1, s~hich is a drainage area. In June, 1984, the Council decided that since Tracts A, f3, C, antl D were not fi1ed, no building permits wvould be issued for these tracts and this was confirmed to P'Ir< Schletty in ~ariting t>y the City ,4ttorney. Fahey reported at this point "1r. Pat Frattalone has expressed interest in one of t'ne tracts for the ~urpose of building a horne< P~r. Frattalone received s:;~sinformation at Cit,y Nall that the tract tda.s ~iuildab1e. Fahey rep=3F=ted that it is his opinion that if Mr. Schletty wants to pursue the resubclivision of Tracts F1, E3, C, or ~ he can reapply and the Council will call a public hearing at which the neighbors can o~~e e~~_
