Fahey outlined the history of Sch7etty 4l oods for those on the <br /> Council vaho u~ere unfamiliar ~d?th it. In the Fall of 1978, Mr. Fred <br /> Schletty originally platted Schletty ldoods, At that time Tracts <br /> l~, 3, C, and D!a~ere not included in the plat as huildab3e lots but <br /> were part of the outlot. Outlot 11 was shoa~n as a drainage easen~ent. <br />In P9ay, 1979, F-1r. Sch1etty requested the resubdivision of Tracts <br />A, B, C, and D to be carved out of Outlot A due to tne omission of <br />these tracts from the plat as an error on the part of ~4r. Schletty's <br />engi neer, Thi s evas approved by the Ci ty Counci 1. lio~riever, the <br />question arose as to vlhether there yvas notice given to the neighbors <br />on the matter> The conclusion was that the Council did approve <br />Tracts A, t3, C, and D in P9ay of 1979, but Mr. Schletty never filed <br />the tracts and thus the action became null and void. The neighbors <br />have taken the position that P4r. Schletty informed them that <br />Tracts A, ~3, C, and D v~roulci remain part of Outlot !1, s~hich is a <br />drainage area. <br />In June, 1984, the Council decided that since Tracts A, f3, C, antl D <br />were not fi1ed, no building permits wvould be issued for these <br />tracts and this was confirmed to P'Ir< Schletty in ~ariting t>y the <br />City ,4ttorney. <br />Fahey reported at this point "1r. Pat Frattalone has expressed interest <br />in one of t'ne tracts for the ~urpose of building a horne< P~r. <br />Frattalone received s:;~sinformation at Cit,y Nall that the tract <br />tda.s ~iuildab1e. <br />Fahey rep=3F=ted that it is his opinion that if Mr. Schletty wants to <br />pursue the resubclivision of Tracts F1, E3, C, or ~ he can reapply and <br />the Council will call a public hearing at which the neighbors can <br />o~~e e~~_ <br />
