MINUTES <br />City Council <br />Jan. 28, 1987 <br />Tulgren Council tabled action on the Tulgren Liquor License matter until <br />Liquor the February 11, 1987 Council meeting. <br />License <br />Agenda <br />Item No. 11 <br />Thomas Mr. Thomas Hardy, D/B/A Zeta Corporation, appeared before the <br />Hardy Council requesting approval of a conditional use permit to allow <br />Conditional retail sales as an accessory use in a Light Industrial District. <br />Use Permit <br /> Fahey pointed out that the Planning Commission voted to recommend <br />Agenda approval subject to the recommendations of the City Planner with <br />Item No. 12 revision of those recommendations to allow for 52 retail sales <br /> per year, the elimination of recommendation #8 and the stipulation <br /> that this license is to be considered the second used car sales <br /> license in the City. <br /> Mr. Hardy reported that retail sales are a small portion of his <br /> business, but he would like to opportunity to make these types of <br /> sales. <br />Mr. Blesener asked if Mr. Hardy will be storing cars outside his <br />building. <br />Mr. Hardy replied that all retail <br />building. Hardy reported that his <br />generally the same day. <br />sales would occur inside the <br />cars leave his site very quickly, <br />Fahey asked if the outside storage of cars was a permitted use. <br />The Planner replied that outdoor storage in Ryan Industrial Park is <br />a permitted use, however, the ordinance requires that retail sales <br />occur indoors. <br />Scalze questioned how the City was going to be able to determine <br />how many retail sales occur on-site in a year. <br />The Planner agreed that this will be difficult to enforce and this <br />was the reason that he originally recommended against retail sales <br />on site. Nowever, the Planning Commission directed him to work with <br />the applicant to try to accommodate his request. Thus, the Planner <br />then recommended that retail sales be limited to 25 vehicles per <br />year, after Mr. Nardy indicated to him that he would sell 1 to 2 <br />vehicles on a retail basis per month. However, at the Planning <br />Commission meeting, it was recommended that P1r. Hardy be allowed <br />1 retail sale per week. <br />Mr. Hardy pointed out that the site does not lend itself to retail <br />sales, and if this was the principle portion of his business, he <br />would not have chosen this site.
