RESOLUTIONS <br />City Council <br />Feb. 11, 1987 <br />Imp. No. Fahey suggested that for the special meeting the Engineer obtain <br />87-1 prices for the road as well as the possibility of bringing water <br />(Cont.) in on Woodlyn Avenue. Fahey also suggested that Councilmembers <br />look at the area prior to the meeting. <br />The Engineer pointed out that along Woodlyn Avenue it will be <br />possible to assess watermain improvement on both sides of the <br />street, however, it will be expensive to jack watermain under <br />the railroad. <br />Klein Mr. Fahey pointed out that the Council has received a report from <br />Fence the Planner, letter from Mr. McCulloch and letter from Mrs. Klein <br />Matter regarding the fence matter involving Mrs. Klein and Mr. McCulloch. <br />Agenda Fahey reported that he has talked with Mr. McCulloch and he stated <br />Item No. 11 that he will replace the front portion of the wooden fence with <br />chain-link fence and will turn the fence so that the good side is <br />facing the Klein property. However, McCulloch indicated that <br />he will not replace the fence with a basket-weave design. McCulloch <br />believes that he has complied with the direction he received from <br />the City Planner and stated that he will oppose the City if they <br />direct him to replace the fence. <br />Mrs. Klein indicated that when the McCulloch Conditional Use Permit <br />was approved it was conditioned that the fence was satisfactory to <br />her. Klein stated that she requested the same type of fence that <br />was installed on her north property line. The City agreed to this <br />and it is documented in minutes of Council meetings. Klein stated <br />that she hoped the Council would not allow Mr. McCulloch to go <br />back on this agreement at this point. Klein was concerned with <br />the amount of time and effort that she has had to make in this <br />matter and was tired of waiting for the problem to be resolved. <br />Scalze noted that it was on April 24, 1985 when Bill Stenger <br />approached with the McCulloch CUP request. Scalze felt that the <br />City Attorney should research the minutes and Council tape to <br />determine the agreement the City had with McCulloch. <br />Fahey indicated that there could have been a mix-up by City Staff <br />as to what McCulloch was required to do. <br />Klein pointed out that she had discussed the matter with both the <br />Building Inspector and Planner. <br />Fahey stated that he does not believe the ordinance has been <br />violated, however, felt that action should be tabled for two <br />weeks until the Attorney can prepare an opinion. <br />Klein stated that she, too, would like copies of the Council minutes <br />on this matter. <br />Page -5- <br />
