MINUTES City Council Feb. 25, 1987 Zoning Revision Nearing (Cont.) False Alarm Ordinance Agenda Item No. 10 RESOLUTION N0. 87-2-79 - SETTING A HEARING FOR MARCH 25, 1987 TO CONSIDER ZONING REVISIONS AS PRESENTED BY THE CITY PLANNER The foregoing resolution was duly seconded by Mr. Blesener. Ayes (5) Scalze, Blesener, Collova, LaValle, Fahey. Nays (01. Resolution declared adopted. This resolution appears in Resolution Book No. 17, Page 84. LaVa17e questioned including bingo under the definition of commercial recreation. LaValle pointed out that this matter is being addressed in the Legislature. The City Clerk felt that reference to commercial in this case meant the zoning district. Council pointed out that there are instances where bingo is held in Public Districts. The City Attorney presented to the Council for approval a proposed ordinance regarding false alarms. The Attorney reported that Section 816.040 A has been revised to charge a penalty of $25 for 4 through 12 false alarms rather than $50, and Section 816.020 C has been revised to include the Fire Department. Council discussed the penalty for false alarms. LaValle felt that the $50 penalty was too high for residential users. However, in comparing the penalties being charged by other cities, it was the concensus of the Council that the penalty for 4 through 12 false alarms should be $50 per false alarm. Council also discussed the fact of the inconvenience and hazard it is to the City's volunteer Fire Department to be called out on false alarm calls. Mr. Blesener introduced the followin~ ordinance and moved its adoption: ORDINANCE N0. 281 - ADDING CHAPTER 816 TO THE MUNICIPAL CODE OF THE CITY OF LITTLE CANADA REGULATING THE USE OF ALARM SYSTEMS, ESTABLISHING USER FEES, AND PROVIDING PENALTIES FOR FALSE ALARMS WITH THE INCLUSION OF "FIRE DEPARTP4ENT IN SECTION 916.020 C AND A PENALTY OF $50 FOR 4 THROUGH 12 FALSE ALARMS IN SECTION 816.040 A Page -10-
