MINUTES
City Council
Feb. 25, 1987
Union 76
Sign
Height
Variance
Agenda
Item No. 5
Mayor Fahey opened the Public Hearing on the request of Roger
Phillips for a sign height variance at the Union 76 station located
on Little Canada Road.
Bob Sherlock, Suburban Lighting, appeared before the Council
representing Mr. Phillips and reported that Mr. Phillips is the
franchisee of the station. Mobile and Union 76 have traded
properties and the station will become a Union 76 station. Therefore,
Mr. Phillips is requesting a sign height variance so that he can
change the signage to Union 76.
Mrs. Scalze pointed out that Mr. Phillips has been the franchisee of
this station for the past 17 years, and all that is happening is that
the station is changing names.
Fahey pointed out that the Planning Commission has recommended
approval of the variance request as there is no change in the
franchisee of the business.
Fahey felt that as there was no change in the franchisee of the
property, a variance was not necessary to change the existing signs
to Union 76 signs. However, should the franchisee of the property
change, then the City's sign ordinance would become applicable, and
signs would have to be brought into conformance.
There was no one present from the general public wishing to comment.
Mrs. Scalze introduced the following resolution and moved its adoption:
RESOLUTION N0. 87-2-74 - CLOSING THE PUBLIC
HEARING ON THE VARIANCE REQUEST FOR SIGN HEIGHT
MADE BY ROGER PHILLIPS
The foregoing resolution was duly seconded by Mr. Blesener.
Ayes (5) Scalze, Blesener, Collova, Fahey, LaValle.
Nays (0).
Resolution declared adopted.
This resolution appears in Resolution Book Mo. 17, Page 78.
The City Clerk pointed out that there are five legal descriptions
for this property. The Clerk suggested that the City require a
registered land survey of the property to simplify the legal
description.
Council pointed out that since a variance is not necessary, there
is no request to tie this condition to.
Mr. Fahey introduced the following resolution and moved its adoption:
Page -3-
