MINUTES <br />CITY COUNCIL <br />JANUARY 8, 2025 <br />• Approve Fire Department Training as an Alternative Use for 2886 Centerville Road <br />• Approve First Amendment to Agreement with Republic Services for Refuse Services <br />• Approve Replacement of Keyless Entry System at Little Canada Fire Station <br />The foregoing resolution was duly seconded by Miller. <br />Ayes (5). Nays (0). Resolution declared adopted. <br />STAFF REPORTS <br />ADOPT ORDINANCES 902, 9032 904, AND 905, AMENDING THE CITY CODE AND <br />ZONING CODE FOR CANNABIS BUSINESS ZONING AND REGULATIONS <br />The Community Development Director provided background information on this topic, including the <br />public hearing held by the Council on December 18th where additional direction was given to staff. He <br />stated that since that time staff have removed the proposed buffers from daycares and residential <br />treatment facilities in the ordinances as discussed and no other changes were made. He briefly <br />recapped what the City is able to regulate for cannabis businesses and provided a summary of the <br />proposed ordinance and buffer changes. <br />Gutierrez appreciated the additional time that staff spent investigating locations of daycares and <br />treatment facilities. <br />Mayor Fischer acknowledged that the City will manage this through the number of allowed businesses, <br />the zoning regulations, and buffers. <br />Malone recognized that removal of the buffers would not impact existing daycares and treatment <br />facilities because of other buffers that exist in those areas but asked how the removal of the buffers <br />would impact new businesses. She referenced the daycare across the highway and asked if the odor <br />would travel over the highway. <br />The Community Development Director replied that would depend -upon the type of cannabis business <br />as a retailer would likely not have an odor that would travel. He stated that for those growing, the odor <br />could potentially travel regardless of whether it is within that buffer area or just outside of it. He <br />explained that the buffer would not prevent a daycare from opening within that area, it would only <br />prevent a cannabis business from opening within that buffer. <br />Malone commented that if there is no buffer from a daycare a cannabis business could then come in <br />within 500 feet of a daycare. She commented that 500 feet is not that far, and she would prefer to keep <br />the 500-foot buffer, as it could be reduced in the past. <br />Miller commented that cultivators would be within the 1-1 district, compared to retail. <br />Gutierrez stated that the Council spent quite a bit of time a few months ago reviewing the different <br />buffers and the areas of the city where these businesses could be, and the Council felt comfortable with <br />the spaces that would be left for these businesses to open. <br />2 <br />
