104 1-te <br />CITY COUNCIL <br />JANUARY 8, 2025 <br />Miller commented that these are cash businesses and therefore it would be desired to have an easy in, <br />easy out and they do not want to push these into a corner. Mayor Fischer understood the concern of <br />Malone, noting that is a what -if scenario. He commented that there is a school located in the industrial <br />zone and if a daycare were to open in a strip mall, then they would also be aware of what else could be <br />allowed in that area. He stated that there needs to be balance in understanding that a cannabis business <br />is a legal business, and the City needs to accommodate one retail business. He stated that the Council <br />reviewed similar buffering for alcohol and tobacco and for predatory offenders. <br />Malone acknowledged that the City needs to allow for one business but could allow more than that. <br />Kwapick stated that would require this entire conversation to be reopened and the process to occur <br />again in order to change the allowed number of businesses, at which time buffers could again be <br />discussed. <br />Gutierrez asked why the cannabis rules would be made different than the alcohol or tobacco rules. <br />The Community Development Director explained that it is more difficult to track daycare locations as <br />well. He explained that while there is a requirement to register with the state, not all facilities do that, <br />and that information is not reported to the City which then puts the onus on the City to constantly <br />check for locations. <br />Miller stated that the Council believed that this should be similar to alcohol and tobacco regulations. <br />Mayor Fischer reiterated that the City will be authorizing one license at this time. He stated that if the <br />City chose to expand that to allow a second business, they could again discuss buffers. He believed <br />that what is proposed is fair and allows this type of business to operate in a location that would be safe <br />for the business and the customers. Miller noted that the security for these businesses is high as well. <br />The Community Development Director stated that this type of business must submit a security plan as <br />well as an odor mitigation plan as well. Gutierrez commented that retail businesses do not have an <br />odor. <br />Mayor Fischer acknowledged that there was not full consensus on the distance and buffers but was <br />unsure that consensus would be reached. <br />Gutierrez introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2025-1-3 —ADOPTING ORDINANCE 902, WHICH CREATES CITY <br />CODE CHAPTER 827, CANNABIS, AND APPROVING SUMMAR Y PUBLICA TION OF <br />THE ORDINANCE <br />The foregoing resolution was duly seconded by Kwapick. <br />Ayes (4).
