Valento
Agenda informed her that there is time to get a request in to the
Addition Legislature for additional liquor licenses.
Scalze asked if it would be possible to put restrictions on new
licenses requiring a certain amount of square footage in a
development, etc. in order to qualify for a liquor license.
The City Attorney reported that the City has total discretion in
the issuance of liquor licenses. However, current Code does not
contain any restrictions.
Scqalze felt that either such restrictions added to the Code
or a policy set up outlining what the City requirements would
be for a new liquor license. Scalze felt that without the
availability of a liquor license, the City will not attract a
hotel/motel or a good restaurant facility.
The City Clerk pointed out that there are existing restaurants in
the City without liquor licenses, and asked what would prevent
them from applying should the City be granted additional licenses
by the Legislature.
Again, the City Attorney pointed out that the City has total
discretion in granting liquor licenses. The Attorney pointed
out that if the City puts restrictions on the issuance of liquor
licenses, asked if these restrictions would apply to liquor license
transfers of existing licenses.
Page -10-
