MINUTES <br />City Council <br />April 22, 1987 <br />Becker Lot <br />Split <br />(Cont.) <br />Scalze pointed out that when Becker purchased the property, it was <br />two separate lots, which he then combined. Becker had wanted to <br />place his house in the middle of the lots. <br />Fahey pointed out that if Becker had placed his house further <br />east there would have been no problem. <br />Scalze indicated that the neighborhood has large lots. <br />Becker disagreed and pointed out that there are two duplexes in <br />the neighborhood with relatively small lots. <br />Mr. Buse, property owner on Vanderbie, appeared before the Council. <br />Buse reported that he is representing the neighbors and they are <br />against the lot split and variance. Buse reported that parking in <br />the area is already congested and felt the proposal would add to <br />the problem. <br />Fahey pointed out that the property division would be a departure <br />from what the City has done in the past, and Fahey indicated that <br />he was opposed to the variance. <br />Becker disagreed that the lot split would congest the neighborhood <br />and pointed out that the Buse lot is smaller than his property. <br />Becker pointed out that the Council has before it for consideration <br />tonight an ordinance which would allow houses built prior to 1980 <br />to have 5 foot sideyard setbacks. Becker pointed out that he was <br />not able to divide his property prior to 1980 as the City controlled <br />the property due to the thoroughfare plan. <br />Fahey agreed that the proposed ordinance would apply to lots that <br />are in place prior to 1980. <br />Scalze explained the purpose of the proposed ordinance, and indicated <br />that she felt the Becker proposal was different because Mr. 6ecker <br />purchased two lots which he then combined. <br />Fahey agreed that if Becker had divided the property before 1980, <br />the ordinance would have applied. <br />Becker again pointed out that he couldn't do this because of the <br />City's thoroughfare plan. The proposed road was not vacated until <br />1982. <br />There was no one else present wishing to comment on this proposal. <br />Mrs. Scalze introduced the following resolution and moved its adoption: <br />RESOLUTION N0. 87-4-153 - CLOSING THE <br />PUBLIC HEARING ON THE BECKER REQUEST <br />FOR LOT SPLIT AND SIDEYARD SETBACK VARIANCE <br />Page -4- <br />
