MINUTES <br />City Council <br />April 22, 1987 <br />Bingo <br />(Cont.) <br />Fahey asked if the charities would meet compliance regulations. <br />Babel replied that for the year in total the charities would not <br />due to start-up expenses. However, these costs removed, the charities <br />will make it on a month-by-month basis at this point. <br />~lesener indicated that this is another issue that should be <br />addressed by the Gambling Control Board. The Attorney agreed <br />that it was the Board's function to determine compliance. <br />Scalze asked if LCCB allows the charities to come into compliance <br />when they would otherwise not. <br />Fahey noted that an annual certified audit is required. <br />Council discussed whether to vote to deny the licenses or if a <br />special meeting should be called. Fahey pointed out that a vote <br />to deny the licenses may close the hall for a time period. <br />Mr. Blesener introduced the following resolution and moved its adoption: <br />RESOLUTION N0. 87-0.-167 - DENYING THE RENEWAL <br />OF THE CHARITABLE GAM6LIPIG LICENSES FOR THE <br />NORTN SUBURBAN DAC, LIONS CLUB, SERVANTS OF MARY, <br />ST. JOSEPH'S SOCIETY AND THE HUMANE SOCIETY BASED <br />ON THE NUMBER OF QUESTIONS RAISED AS FAR AS <br />LEGALITY OF TNE ORGANIZATION OF THE HALL ASSOCIATION <br />AND THE FACT THAT NO RESPONSE HAS BEEN RECEIVED FROM <br />THE CHARITABLE GAMBLING CONTROL BOARD ON THIS ISSUE, <br />AND IT IS THE CITY'S FEELING, BASED ON THE OPINION <br />OF THE CITY ATTORNEY, THAT THE HALL ASSOCIATION IS <br />NOT A LEGAL BOARD <br />The foregoing resolution was duly seconded by Mrs. Scalze. <br />Ayes (4) Blesener, Scalze, Fahey, LaValle. <br />Nays (1) Collova. <br />Resolution declared adopted. <br />This resolution appears in Resolution Book No. 17, Page 181. <br />Mr. Collova stated that he voted against denial as he felt it was <br />premature at this point. <br />Fahey felt that the City Attorney should make a formal request for <br />an opinion from the Gambling Control Board as well as submit an <br />organizational structure of the Hall Association, and information <br />on Board members. <br />The City Attorney noted that the information on the structure and <br />Board members will have to be provided by Mr. Wylie. <br />Page -30- <br />
