MINUTES <br />City Council <br />May 13, 1987 <br />6Joodpi 1 es <br />(Cont.) <br />LaValle was concerned that the ordinance would not be enforceable, <br />and felt that the City should not enact ordinances that will not <br />be enforced. <br />Collova pointed out that 98% of woodpiles in the City are not elevated <br />off the ground and will probably remain in violation of the ordinance <br />until that wood is used up. <br />Fahey suggested that the ordinance state that where conditions warrant, <br />the Building Inspector will require the elevation of a woodpile to not <br />less than 8 inches. <br />The City Attorney felt that the ordinance would be tougher to enforce <br />with such a provision. <br />Collova felt that the ordinance should be enforced if a woodpile is <br />causing a public nuisance or hazard. <br />LaValle felt that the City already had the power to regulate woodpiles <br />under the public nuisance portion of the ordinance. <br />Fahey felt that the ordinance should be adopted as proposed. <br />Mr. Fahey introduced the following resolution and moved its adoption: <br />RFSOLUTION N0. 87-5-210 - DIRECTING THE CITY <br />ATTORNEY TO PREPARE AN ORDINANCE AMENDIPlG <br />CHAPTER 601 WITH TNE P40DIFICATIONS THAT ulOODPILES <br />BE ALLOWED TO BE STORED ON NON-IP1PERVIOUS MATERIALS <br />SUCH AS POURED CONCRETE OR A MINIMUM OF 8-INCHES <br />OFF THE GROU~ID AND THAT WOODPILES WILL BE ALLOWEO <br />IN REAR OR SIDE YARDS, HOWEVER, NOT WITHIPJ THE <br />REQUIRED REAR OR SIDE YARD SETBACK AND THAT WOODPILES <br />MUST BE LOCATED AT LEAST ONE FOOT FROM A RESIDENCE <br />Spooner <br />Park <br />Agenda <br />Item No. 18a <br />The foregoing resolution was duly seconded by Mr. Blesener. <br />Ayes (4) Fahey, Blesener, Collova, Scalze. <br />Nays (1) LaValle. <br />Resolution declared adopted. <br />This resolution appears in Resolution Book No. 17, Page 228. <br />Scalze reported that the grant application has been submitted for <br />funding to acquire Spooner Park. Also, if the Council is interested <br />the City Clerk has a copy of the appraisal that was received on the <br />property. <br />Page -15- <br />
