MINUTES City Council May 13, 1987 6Joodpi 1 es (Cont.) LaValle was concerned that the ordinance would not be enforceable, and felt that the City should not enact ordinances that will not be enforced. Collova pointed out that 98% of woodpiles in the City are not elevated off the ground and will probably remain in violation of the ordinance until that wood is used up. Fahey suggested that the ordinance state that where conditions warrant, the Building Inspector will require the elevation of a woodpile to not less than 8 inches. The City Attorney felt that the ordinance would be tougher to enforce with such a provision. Collova felt that the ordinance should be enforced if a woodpile is causing a public nuisance or hazard. LaValle felt that the City already had the power to regulate woodpiles under the public nuisance portion of the ordinance. Fahey felt that the ordinance should be adopted as proposed. Mr. Fahey introduced the following resolution and moved its adoption: RFSOLUTION N0. 87-5-210 - DIRECTING THE CITY ATTORNEY TO PREPARE AN ORDINANCE AMENDIPlG CHAPTER 601 WITH TNE P40DIFICATIONS THAT ulOODPILES BE ALLOWED TO BE STORED ON NON-IP1PERVIOUS MATERIALS SUCH AS POURED CONCRETE OR A MINIMUM OF 8-INCHES OFF THE GROU~ID AND THAT WOODPILES WILL BE ALLOWEO IN REAR OR SIDE YARDS, HOWEVER, NOT WITHIPJ THE REQUIRED REAR OR SIDE YARD SETBACK AND THAT WOODPILES MUST BE LOCATED AT LEAST ONE FOOT FROM A RESIDENCE Spooner Park Agenda Item No. 18a The foregoing resolution was duly seconded by Mr. Blesener. Ayes (4) Fahey, Blesener, Collova, Scalze. Nays (1) LaValle. Resolution declared adopted. This resolution appears in Resolution Book No. 17, Page 228. Scalze reported that the grant application has been submitted for funding to acquire Spooner Park. Also, if the Council is interested the City Clerk has a copy of the appraisal that was received on the property. Page -15-
