MINUTES <br />City Council <br />May 27, 1987 <br />Bingo Suburban DAC is contrary to what Roger Franke has said. In addition, <br />(Cont.) the City Attorney advised the Council that two of the applications <br />were received on P~ay 6 and four were received on May 7, and the <br />Council has to act on these applications ~aithin 30 days of receipt, <br />otherwise the City loses its veto power. <br />Scalze asked if there was any indication that the questions would be <br />answered in the near future. <br />The City Attorney reported that Franke indicated that new materials <br />were submitted at 12:30 P.M. on Tuesday for the Gambling 6oard's <br />meeting at 1:00 P.P1. on Tuesday regarding the issue of trustee <br />appointment and power. The Board felt these materials needed to <br />be reviewed and the issue worked through prior to the next Board <br />meeting. <br />Fahey reported that he had additional concerns, those being the <br />recent actions of the LCCB Board to censor two of the charities' <br />gambling managers and the restrictions placed on these managers <br />while on the premises. Fahey reported that he was very upset by <br />this conduct. <br />Fahey stated that he vdill not endorse or support any bingo on the <br />premises unless there are individual leases with individual <br />charities. Fahey pointed out previous allegations of manipulations <br />by the landlord and felt the action of the Board proved they were <br />capable of the same actions. Fahey felt that if the proposal of <br />a trusteeship were approved, individual charities could be <br />eliminated if they were not agreed with. <br />Fahey felt that the license applications should be denied because <br />the charities have not acted together in terms of providing the <br />State with adequate documentation. Fahey stated that he would not <br />vote to approve the trusteeship as proposed or the Nall Association <br />but only bingo in Little Canada on an individual basis with individual <br />leases. <br />Fahey pointed out that if Movers Warehouse is not being fair in the <br />rents it proposes to charge, the City has the prerogative under <br />State law to set by ordinance the amount of rent that can be <br />charged. Fahey stated that he was in agreement with Councilman <br />LaValle and at this point would not give further consideration to <br />bingo unless on an individual basis with individual leases. <br />LaValle reported that he attended the meeting of the Gambling <br />Control Board and at the meeting Roger Franke was concerned <br />that there are alledgedly taxes owed to the State by LCCB. <br />LaValle indicated that he felt the trusteeship as proposed was <br />not workable under State law. <br />Fahey stated that he was supportive of charitable gambling, but <br />would not support it unless with individual leases, individual <br />Page -18- <br />
