MINUTES <br />City Council <br />June 24, 1987 <br />Rusch CUP Fahey pointed out that the ordinance does not take into account whether <br />8 Variance adjacent property owners are not opposed to variance requests, as <br />(Cont.) properties do change hands. <br />Scalze pointed out that when Rusch originally requested a permit to <br />move a house on the property the Council discussed the location of a <br />future garage and pointed out to Rusch the setbacks that would be <br />required. <br />Rusch pointed out that the request is due to the particular garage that <br />he has acquired. Rusch pointed out that the garage will improve the <br />area. <br />Fahey felt that there was no hardship present to warrant granting the <br />variance. <br />Rusch again raised the issue of the rezoning of the property. <br />The Planner noted that the property was never rezoned, but the ordinance <br />was amended to elimiate the provision for one duplex in every 10 <br />single-family homes. <br />Fahey agreed that the property was never zoned R-?_, and suggested Rusch <br />had a tegal right to pursue the devaluation issue he raised. However, <br />this contention was no basis for granting a variance. <br />P4r.
