MINUTES <br />City Council <br />August 12, 1987 <br />Extended Mr. Collova reported that the School District was considering <br />Day Care leasing St. John's Convent for its extended day care program. <br />However, due to improvements needed to increase the fire rating <br />Agenda in the building, the School District is no longer considering <br />Item No. 18a this option. <br />Lake Gervais Scalze outlined recent City actions regarding a no wake order on <br />High Water Gervais Lake to prevent high water erosion of property around the <br />Level lake. This order was put into effect at the 860.3 elevation and <br /> the boat ramp at Spoon Lake closed for a few days. Also, residents <br />Agenda around the lake agreed to the order and did not use the lake for <br />Item No. 19a those few days. <br /> Scalze reported that she has discussed this matter with the County <br /> Engineer who informed her that Gervais is a State-operated lake <br /> and the residents on the lake must petition the City to enact a <br /> no-wake ordinance setting a certain level at which this order would <br /> go into effect. <br /> Scalze pointed out that Lake Owasso and Lake Johanna have these <br /> restrictions, however, Gervais does not. <br /> Scalze felt that this is something that should be taken care of. <br />Council felt that the City Attorney should put together an ordinance <br />using model ordinances from the County or surrounding communities for <br />Council consideration. The Council could then call a public hearing <br />at which the property owners on Gervais would have input. <br />LaValle reported that Arden Nills has an ordinance in effect which <br />restricts various activities on the lake during certain hours. LaValle <br />felt this was something the City might want to consider. <br />Fahey pointed out that no one has requested those kinds of restrictions, <br />and felt the City should not enact something like this unless requested <br />to do so by the property owners on Gervais. However, Fahey felt that <br />a no wake ordinance was beneficial to the property owners in protecting <br />their property from erosion. <br />LaValle reported that he has had requests for an ordinance restricting <br />activities on the lake. <br />Fahey suggested that LaValle submit the ordinance for Council review, <br />but if the Council was not interested in pursuing it, no public hearing <br />would be called. <br />Council discussed ways for setting a high water level at which a <br />no wake order would go into effect, and it was suggested that the <br />County and DNR be contacted for their input in the matter. <br />Mr. Fahey introduced the following resolution and moved its adoption: <br />Page -16- <br />
