MINUTES <br />City Council <br />August 12, 19&7 <br />Locomotive Struck informed the Council that thereare State statutes on the books <br />Whistles regarding whistle blowing, therefore, the City of St. Paul has not <br />(Cont.) enacted any ordinance. Struck also informed the Council that the <br />railroad has taken the attitude that unless it is requested not to <br />blow whistles at crossings by local municipalities, it will continue <br />to do so. Stnuck also reported that the railroad explained that they <br />consider eminent danger to life or property to be a situation where <br />someone or something is on the track. <br />Struck also reported that the Soo Line has been requested by other <br />cities it crosses not to blow whistles in certain segments of track. <br />Fahey noted that the crossing at County Road B-2 and Viking Drive is <br />signalized, but the one on Demont does not have a signal nor a gate. <br />Blesener felt that the crossings with no signals or gates should be <br />excluded from the request. <br />Council also discussed the City's requesting the railroad not to sound <br />whistles at signalized or gated crossings, rather than going through <br />the expense of enacting an ordinance noting that State law already <br />covers this matter. <br />Mr. Fahey introduced the following resolution and moved its adoption: <br />RESOLUTION N0. 87-8-357 - INSTRUCTING THE <br />CITY CLERK TO WRITE A LETTER TO THE S00 LIPIE <br />RAILROAD AND REQUEST THAT THEIR TRAINS NOT <br />SOUND WHISTLES AT GATED OR SIGNALIZED RAILROAD <br />CROSSINGS WITHIN THE CITY OF LITTLE CANADA <br />PURSUANT TO STATE STATUTES ON THIS MATTER <br />The foregoing resolution was duly seconded by Mr. Blesener. <br />Ayes (5) Fahey, Blesener, Scalze, LaValle, Collova. <br />Nays (0). <br />Resolution declared adopted. <br />This resolution appears in Resolution Book No. 18, Page 383. <br />Fahey instructed the City Clerk to send a copy of the railroad's <br />response to Mr. Struck. <br />Sophie/ Mr. Marcel Eibensteiner, one of the developers of the Sophie/Peterson <br />Peterson plat, appeared before the Council requesting a refund of the assessments <br />Plat for two 95 foot lots on Allen Avenue. Eibensteiner explained that he <br />and Gordie Howe developed the Sophie/Peterson property, however, it <br />Agenda was previously agreed to with the Council that the assessments for <br />Item No. 7 these two lots on Allen Avenue would be paid for by the benefited <br />property owners. <br />Page -3- <br />
