MINUTES <br />City Council <br />August 12, 1987 <br />Sophie/ The City Engineer reported that Mr. Eibensteiner's position is correct <br />Peterson and reported that he has calculated the amount of the improvement for <br />Plat (Cont.) these two lots at $12,409.40, which should be refunded to the developers. <br />Blesener pointed out that while the property owners were to be charged <br />for their 95-foot lots, the cost of the improvement along the sideyards <br />on Allen was to be borne by the developers of the Sophie/Peterson plat. <br />Eibensteiner agreed with Mr. Blesener's statement as well as the <br />amount of refund calculated by the City Engineer. <br />Mr. Don Tarnowski, property owner on Greenbrier and Allen, questioned <br />the City's assessing the cost of the improvement of Allen Avenue <br />against his property. Tarnowski also stated that he was informed that <br />he would also be assessed for water. Tarnowski pointed out that in <br />both May and June he appeared before the Council opposing the <br />improvement and pointed out that he does not want to divide his <br />property. Tarnowski commented that he has already paid special <br />assessments on his property and does not believe that either he or <br />Mr. Hammer should be assessed for the improvement of Allen Avenue. <br />Fahey noted that since the Tarnowski property would be splitable, <br />the cost of the improvement would be assessed against the property. <br />If there is reason for a deferment of the assessment, that will be <br />considered at the assessment hearing. <br />The Engineer pointed out the cost of the improvement is $62 per <br />front foot compared to $152 per front foot for Sylvan. The Engineer <br />also pointed out that the Tarnowski property will not be assessed <br />for water as Mr. Eibensteiner was required to loop the watermain <br />into Greenbrier, and, therefore, would pick up the full watermain <br />assessment. <br />Mr. Collova questioned the involvement of Gordie Howe in the development. <br />Eibensteiner reported that Mr. Howe purchased the Peterson property, <br />while he purchased the Sophie property and the two jointly developed <br />the plat. <br />Tarnowski reported that Mr. Howe informed him that he would pick up <br />the full assessment for Allen Avenue. <br />Fahey noted that this was never represented to the Council and the <br />City agreed that Eibensteiner would put in the improvements and the <br />City would reimburse him for the cost of the improvement for the two <br />95 foot lots which would be created on Allen Avenue. <br />Tarnowski pointed out that there are not two 95-foot lots on Allen. <br />Fahey indicated that there is the potential for two 95-foot lots on <br />Allen. <br />Page -4- <br />
