No. Fahey questioned whether or not is was legal to assess a high- <br />86-7A, density development more than a single-family development. <br />86-7A2, & <br />86-7 (Cont.) Demont pointed out the increased traffic on the road from the <br />high-density development. Demont felt that the single-family <br />properties were subsidizing the high-density development. <br />Scalze pointed out that the high-density development is paying <br />more taxes per square foot than the single-family. <br />Fahey suggested that the Council consider this issue at its meeting <br />in two weeks. Fahey noted. that this was the first street that was <br />put in that fronts on both multiple-family and single-family. <br />The City Engineer pointed out that there is 1,300 feet of road <br />serving 250 units on the south and 1,300 feet of road serving <br />12 units on the north. <br />Fahey suggested the City Attorney research the legal soundness of <br />assessing the higher-density development at a higher rate than the <br />single-family. Fahey asked for a report in two weeks. <br />Gary Sody, 143 Canterbury Court, representing the Townhome Association, <br />reported that they have only one driveway access on Demont and asked <br />how access would be provided to them once construction starts. Sody <br />also asked the timing of the project. <br />Frank Frattalone, the contractor improving Demont, replied that <br />access would be provided at all times. Frattalone also estimated <br />that the first layer of blacktop would be on the street by the <br />end of the year. Frattalone reported that the project has been <br />delayed to the west due to a problem in getting utilities moved. <br />However, that has been resolved. Frattalone also reported that <br />the west side of the improvement will have gravel down on the <br />road before work is started on the east. Frattalone also pointed <br />out that about60% to 70% of the work is on the west side and work <br />on the east will proceed quickly. <br />Sody reported that in reply to Mr. Demont's comments, the single- <br />family homes enjoy much more of the road than the multiple family <br />homes on the south. <br />The City Clerk reported that the townhouses will pay $12,000 in <br />assessments, the Canabury Condos will pay $18,000 in assessments <br />and Canabury Square will pay $23,000 in assessments. <br />Scalze noted the stockpiling of dirt on the City lot at Ruth and <br />Demont. <br />Frattalone reported that it is necessary to stockpile the dirt <br />which will be used in backfilling the ditches once the storm sewer <br />is put in. <br />Page -15- <br />
