MINUTES <br />City Council <br />October• 28, 1987 <br />Nauth Mr•. Blesener• indicated that he was in favor• of a fr•ont yar•d setback <br />Pr•oper•ty var•i ance of a few feet, but was not i n favor• of a 20 foot var•i ance <br />Division as being r•equested by Mr~. Hauth. <br />& Variance <br />(Cont.) The City Planner• noted that the str•eet r•ight-of-way for• Sylvan thr•ough <br />to Demont has not been vacated, and asked if ther•e was the potential <br />for• the str•eet to be extended in the futur•e. If not, the Planner• <br />suggested that the r~ight-of-way be vacated and houses be allowed to <br />build ar~ound the cul-de-sac as is nor•mally done on cul-de-sacs. <br />The Ci ty Engi neer~ agr•eed that the str•eet r~i ght-of-way for• Syl van <br />thr•ough to Demont should be vacated, however, it will be necessar•y <br />to r•etain a utility easement. <br />Scalze did not feel that the City should gr~ant a var•iance unless ther•e is <br />a specific r~equest for~ a var~iance. <br />Blesener~ suggested that the lot split could be acted upon at this time, <br />and the issue of the fr•ont yar•d setback var~iance could be consider•ed <br />at the time ther•e is a r•equest for~ a building per•mit on the lot. <br />Blesener• stated that he was not pr~epar•ed to vote on a var•iance until <br />he knows the size of the var~iance. <br />Ther•e was no one el se pr•esent wi shi ng to comment on the Nauth pr•oper•ty <br />division r~equest. <br />Mr~. Blesener• intr•oduced the following r•esolution and moved its adoption: <br />RESOLUTION N0. 87-10-508 - CLOSING THE <br />PUBLIC HEARING ON THE HAUTN PROPERTY DIVISION <br />AND VARIANCE REQUEST <br />The for~egoing r•esolution was duly seconded by P9r~. Collova. <br />Ayes (5) Blesener, Collova, Fahey, LaValle, Scalze. <br />Nays (0). <br />Resolution declar•ed adopted. <br />This r•esolution appear•s in Resolution Book No. 18, Page 536. <br />Scalze noted that without the easement ar•ea, the Hauth lot will be <br />under• the City's 10,000 squar~e foot ar•ea r•equir~ement. <br />The Planner~ agr•eed, but noted that easement ar•ea is not subtr•acted <br />fr~om the ar~ea of a lot. <br />The City Attor~ney noted that when this mattev~ was fir~st addr•essed, <br />the Council indicated that in r~etur•n for• r•oad easement for• the Sylvan <br />Str•eet cul-de-sac, the City would gr•ant whatever~ variance necessar•y <br />for• the lots ar~ound the cul-de-sac. <br />Fahey agr•eed, indicating that the Council agreed to gr•ant lot ar•ea <br />Page -5- <br />
