MINUTES <br />City Council <br />Nov. 4, 1987 <br />En~ Fahey suggested that the Engineer• wor•k with the County, State, and <br />Dr•ai nage Water~shed on a sol uti on to the pr•obl em. <br />Matter• <br />Cont.) Scalze suggested that the Engineer• take a look at the cur•bing in <br />fr•ont of the Eng house as well. <br />Fahey agr~eed. <br />Eng felt that the basic pr~oblem was the cur~bing which is dir•ecting <br />water~ into his yar•d like a faucet. <br />The City Engineer reported that he will infor•m the Council of his <br />findings at their• next meeting. <br />Scalze suggested that the Engineer~ also look into the cost of moving <br />the culver~ts as has been suggested by Mr•. Eng. <br />Ganzel Mr•. Kelly, attor•ney r~epr•esenting Mr~. and Mr•s. Ganzel, r~epor•ted that <br />Dr•ainage his clients have r•ejected the City's offer~ of $500 in payment for <br />Matter the stor~m sewer~ easement on their• pr•oper•ty. His clients have <br />Cont.) requested that the stor~m sewer• pipe be r•emoved. Kelly thanked the <br />Council for• their~ cour~tesy. <br />The City Attor~ney pointed out that the City will need an easement <br />giving them r~ight of entr•y to r~emove the stor•m sewer• pipe. <br />Kelly r~epor~ted that he would be in contact with the City Attor~ney. <br />Waite The City Attor•ney repor•ted that at the last Council meeting Rockne <br />Subdivision Waite r~equested that the Council appr•ove the subdivision of his <br />& Var•iance Lots 12 thr~ough 20, Nor~th Heights Addition into thr•ee lots. <br />Matter <br /> The Attor•ney r•epor•ted that he has r•eviewed his file on the matter• <br />Agenda and deter•mined that in 1986 the City Council discussed the issue <br />Item No. 8 that after• taking a per•manent easement for~ the Sylvan Str•eet <br /> cul-de-sac, the combination of Lots 18, 19 and 20 would not meet <br /> the City's 10,000 squar~e foot r•equir•ement. At that time, an <br /> agr•eement was made with Mr~. Waite that if a var•iance was necessar•y <br /> for~ 1 ot ar•ea, one woul d be gr~anted. <br /> The Attor~ney r•ecommended that the Council r•econsider• Mr~. Waite's <br /> subdi vi si on r~equest and al so grant a var•i ance for• 1 ot ar~ea for• the <br /> combination of Lots 18, 19, and 20. <br /> Fahey asked if Council should take this action given the fact that <br /> Mr•. Waite has not applied for~ a var~iance. <br /> Mr. Waite pointed out that while he petitioned for the improvement <br /> of Sylvan thr•ough to Demont, he did not petition for~ the str•eet to <br /> end in a cul-de-sac. <br />Page -11- <br />
