MINUTES
City Council
Dec. 9, 1987
Announcements Mayor• Fahey announced that in conjunction with the Little Canada
Fi r•e Department, Knox Lumber~ 1 ocated on Countr~y Dr•i ve woul d be
Agenda selling batter~y-oper~ated smoke detector•s for• $3.99 this Satur•day,
Item No. 4 December 12th. Fahey r•epor•ted that the Fir~e Depar~tment encour•ages
those homeowner•s whose homes ar•e not equipped with smoke detector•s
to pur•chase and install a smoke detector~.
Fahey announced that a Council wor•kshop meeting will be held on
JANUARY-6-1988 d~d~r~a~y+~' 1988 wi th Deci si on Resour•ces to di scuss the Ci ty' s upcomi ng
sur~vey. Fahey r~epor~ted that the Council is looking for• input on items
that could be included in the survey.
Fahey also announced that wor•k has begun on the Little Canada Road
br•idge over• 35E. Fahey r~epor•ted that towar•ds the end of July or• ear•ly
August the br•idge will be closed entir•ely for~ appr~oximately 3 days,
and suggested that r~esidents may want to begin consider•ing alter•nate
routes as work progresses on the bridge.
Vacation Fahey r•epor•ted that the City has r•eceived a petition fr•om David Gr~oss
Of Lake Str. r~epr•esenting the Midway Bank r•equesting that Lake Str~eet fr~om Par•k
From Park Street to Spruce Street be vacated.
To Spruce
Chr•is Qehm, pr•oper~ty owner• on the cor•ner~ of Lake Street and Spr•uce,
Agenda pointed out that this vacation was r•equested last year• and was denied
Item No. 5 by the Council. Behm r•epor•ted that he has paid assessments on Spr•uce
Str~eet and asked if Lake Str•eet wer~e impr•oved if he would be assessed
for•that street as well.
The City Engineer~ r•epor•ted that if Lake Street were impr•oved, the E3ehm
pr•operty would not be assessed as it r•eceives no benefit fr•om Lake
Street. However, if Lake Street were vacated, the Behm property would
gain another 30 feet of fr•ontage along Spr•uce.
Fahey pointed out to Mr~. Behm that the petition submitted by Midway
Bank r•equesting the vacation is an adequate petition, and under• State
Law the City is r•equir•ed to call a public hear•ing. At that time the
City will consider~ whether• or• not any lots would become unbuildable
by vacating Lake Str~eet, and, if not, the street wou1d be vacated as
it would ser•ve no public pur~pose.
Scalze pointed out that if the Behm pr~oper•ty acquir•es the additional
30 feet thr~ough the vacation, if ther•e is a futur•e impr•ovement on
Spr•uce Str•eet, the Behm pr•oper•ty woul d be assessed for• 105 feet of
fr•ontage r•ather• than 75 feet, which is the cur•r•ent width of the Behm
property.
Mr~. LaValle intr•oduced the following r~esolution and moved its adoption:
RESOLUTION N0. 87-12-569 - CALLING FOR A
PUBLIC HEARING TO CONSIDER THE VACATION OF
LAKE STREET FROM PARK STREET TO SPRUCE
STREET FOR JANUARY 13, 1988
Page -2-
