Ki sr~ow
al so r•epor•ted that she i s tr•yi ng to sel 1 her• house and i s not abl e
to due to the location of this business.
It was noted that the owner• of 3075 LaBor•e Road was not informed of
the complaint and not invited to attend the meeting. Fahey suggested
in the futur~e that when complaints ar•e made and scheduled to be
discussed on the Council agenda, the pr•oper•ty owner• about whom the
complaint is being made should be infor~med.
Kisr~ow r•epor•ted that she moved into her~ pr•oper~ty about 15 months ago,
and since that time the activity and stor•age of equipment on the site
has incr~eased. Kisr•ow again pointed out that the ar~ea is r•esidential
and ther~e ar~e a 1 ot of chi 1 dr~en i n the ar•ea.
Kisr•ow asked if the business has been author~ized by the City to oper•ate
in this location.
The City Cler•k r•eplied that a lawn care business was author~ized at this
location back in 1966 or~ 1967.
Scalze pointed out that lawn car•e does not mean heavy equipment nor~
dumping.
Kisr•ow asked that the landfill be removed as it is destr•oying the
natur~alness of the ar~ea and if the business has been appr•oved for~
this location, that some type of fence be requir~ed to scr•een the
business fr•om the sur•r•ounding r~esidential pr•opert.y.
Scalze stated that she was not convinced that the business was oper~ating
legally in this location.
Scalze also pointed out that the Park Commission is cur•r•ently wor•king
with the owner•s of this pr~oper•ty to tr~y to obtain easements under• the
power• line to complete the City's tr•ail easements thr~ough the ar•ea.
Fahey notetl that the enfor•cement questions r•aised will have to be
wor~ked out separ~ately and without r•egar•d to any tr~ail easement
consider•ations.
~~r~. LaValle intr•oduced the following r~esolution and moved its adoption:
RESOLUTION N0. 88-3-87 - INSTRUCTING THE CITY
CLERK, f3UILDING INSPECTOR AND CITY ENGIPIEER
TO REVIEI~I THE COMPLAINT RECEIVED REGARDING
A BUSINESS AND LANDFILL OPERATING AT 3075
LABORE ROAD AN~ REPORT TO THE COUNCIL AT ITS
~dEXT MEETI~IG
The for~egoing r~esolution was duly seconded by Mr~.
