SUBP9ISSION OF A SATISFACTORY SITE PLAN AND <br />LANDSCAPE PLAN FOR THE SITE WHICH THE CITY <br />CLERK HF~S IPIDICATED IS LACKING FOR THIS SITE <br />The foregoing resolution was duly seconded by Mr. LaValle. <br />Ayes (5) Fahey, LaValle, Collova, Scalze, Blesener. <br />Nays (0). <br />Resolution declar•ed adopted. <br />This r•esolution appear•s in Resolution Qook No. 19, Page 167. <br />Bar~-B-Que Fahey r•epor~ted that the Council has been r•equested to r~eview its cur~r•ent <br />Gr~ills or~dinance r•egulating bar~-b-que gr•ills on apar•tment balconies. Fahey <br />On reported that the current ordinance allows the use of gas burner grills <br />Apar•tment provided they ar~e locked into place to pr•event tipping of the grill. <br />Dalconies Fahey repor•ted that he discussed this with the Fir•e Chief who sees no <br />pr•oblem as long as it is the gas gr•ill being used and the gr•ill is affixed <br />to the balcony. <br />P1r. Fitzgerald, along with P1essrs. 4lells and Kelly, appeared befor•e the <br />Council reporting that they are residents of Canabury Condominiums and <br />they would like to see all gr•ills banned fr•om apar•tment balconies. <br />Fahey r•epor~ted that the Fir•e Mar~shal and Fir•e Chief infor~med him that <br />they have no pr•o61em with condominium associations adopting str•icter• <br />r•egulations and pr•ohibiting gr~ills fr~om balconies. <br />Fahey stated that he saw no pr~oblem with a fixed, gas gr•ill on an <br />apar•tment balcony and Fahey noted that he was a fireman. Fahey stated <br />that the problem arises with charcoal grills which can be tipped over. <br />Col l ova repor~ted that the Fi r~e D9ar•shal has contacted nei ghbor~i ng ci ti es <br />to deter•mine what their• r~egulations ar•e. There ar•e some cities that <br />pr~ohibit gr•ills on apar•tment balconies, however~, the vast major~ity <br />would r~ather that the homeowner•s' association would make the r•ules. <br />Collova pointed out that with the vast number~ of apar•tment units in <br />the City, ther•e is no way the City could enfor~ce this r•egulation. <br />Blesener~ pointed out that Shor•eview r~ecently banned gr•ills on apar~tment <br />balconies, and two weeks later• r~ever•sed this r~uling. <br />Fahey stated that he did not want to become so r~estr•ictive that people <br />coul d not r•easonably use thei r~ pr•oper•ty. Fahey asked i f the Sher•i ff <br />would be able to enfor~ce the Codes on this subject. <br />LaValle assur•ed the Council that the Sher~iff's Depar~tment could enfor~ce <br />this regulation. LaValle agreed that the best appr•oach would be to have <br />the Homeowner•s Association addr~ess the issue. If gr~ills ar~e not banned, <br />Page -18- <br />
