MINUTES
City Council
May 25, 1988
NSP
Powerline
Pr~oper~ty
Agenda
Addition
Scalze r•epor•ted that NSP is willing to dedicate the pr•oper•ty it owns under~
the power•lines for• City par•k pur•poses. NSP would r~etain an easement over•
the pr•oper•ty. The City Cler•k has deter•mined that $4,230.56 in taxes is
gener•ated fr~om thi s pr~oper•ty each year•. The Ci ty al so has the opti on of
enter~ing into a long-term use agreement with NSP.
Scal ze fel t that the amount of taxes gener•ated fr•om the pr~oper•ty was not
substantial and pointed out that the City only r•eceives about 1/4 of those
taxes. Scalze felt that the City's owner~ship of that pr•oper•ty may be
pr•efer•able to a long-ter•m use agr•eement. Liability to the City r•emains
the same in either• instance.
Fahey felt that r•ather• than for•ego the $1,000 in taxes, the City should
enter• into a long-ter•m use agr~eement for• the pr•oper•ty. It was pointed
out that the School Distr~ict and County r•eceives the r•emainder• of the
tax r•evenue.
Fahey suggested that the City Attor•ney investigate a long-ter~m use agr•eement
with NSP.
Scalze felt that both the long-ter•m use agr~eement and City purchase should
be investigated before the City makes a decision one way or~ the other~.
P4r•. Fahey intr~oduced the following r•esolution and moved its adoption:
RESOLUTION N0. 88-5-218 - AUTHORIZING TNE CITY
ATTORNEY TO CONTACT NSP TO DETERMINE IF THE
CITY CAN OBTAIN A LONG-TERM USE AGREEMENT FOR
A TRAIL SYSTEM UNDER THE NSP POWERLINES AT NO
COST TO THE CITY
The for•egoing resolution was duly seconded by Mr•. LaValle.
Ayes (2) Fahey, LaValle.
Nays (3) Scalze, Collova, Blesener•.
Resolution denied.
This r•esolution appear•s in Resolution Book No. 19, Page 220.
Mr•. Blesener• introduced the following reso1ution and moved its adoption:
RESOLUTION N0. 88-5-219 - INSTRUCTING THE CITY
ATTORNEY TO CONTACT NSP TO DETERMINE WHAT THE
CITY'S OPTIONS ARE REGARDING THE USE OF THE
NSP PROPERTY OR POSSIBLY REQUESTING NSP TO TURN
THE PROPERTY OVER TO LITTLE CANADA, AND WNAT
THE COSTS OF DOING SO WOULD BE
The for~egoing r~esolution was duly seconded by Mr~s. Scalze.
Ayes (3) Blesener~, Scalze, Collova.
Nays (2) Fahey, LaValle.
Resolution declar•ed adopted.
This r•esolution appear~s in Resolution Book No. 19, Page 221.
Page -18-
