Fahey intr~oduced the following r~esolution and moved its adoption: <br />RESOLUTION N0. 88-5-202 - APPROVING THE FLEISCHHACKER <br />LOADING DOCK VARIANCE AS REQUESTED ON THE GROUNDS <br />THAT A HARDSHIP WAS PRESENT DUE TO THE ACTIONS OF <br />THE STATE IN REMOVING A LOADING DOCK THROUGH THE <br />WIDENING OF AN ADJACENT STREET AND PROVIDED THAT <br />AS A CONDITION OF THE VARIANCE THE APPLICANT PERFORM <br />GENERAL CLEAN-UP OF THE AREA TO THE SATISFACTION <br />OF THE BUILDING INSPECTOR AND THAT THE APPLICANT SUBMIT <br />A LETTER OF CREDIT IN AN AMOUNT NOT TO EXCEED $1,000, <br />OR LESS IF DETERMINED BY THE BUILDING INSPECTOR, TO <br />ENSURE THAT THE CLEAN-UP IS COP4PLETED WITHIN 90 DAYS <br />The for•egoing r~esolution was duly seconded by Mr•. Collova. <br />Ayes (5) Fahey, Collova, Blesener•, LaValle, Scalze. <br />Nays (0). <br />Resolution declar•ed adopted. <br />This r•esolution appear•s in Resolution Book No. 19, Page 204. <br />Fahey suggested that Mr~. Fleischhacker wor•k with the Building Inspector~ <br />on other• ar~eas of concer•n such as exit signs, spr•inkling and fir•e <br />extinguisher~s. <br />Fahey reopened the public hear~ing on the Boosalis r~equest for• conditional <br />use per•mit. Fahey noted that the Council has r•eceived a number• of <br />differ~ent pr~oposals fr•om the applicant in the last few days as well as <br />a report from the City Planner•. <br />The Ci ty Pl anner• r•epor•ted that hi s r•epor•t addresses the subdi vi si on 1 ay- <br />out and the commer•cial development and he has not r•eviewed the var~ious <br />development lay-outs. <br />Nick Boosalis pr~esented the Council with var~ious development pr~oposals. <br />Boosalis began with an explanation of Plan A, which is basically the <br />same plan for~ the commer•cial development as was previous1y pr•esented <br />to the Council, but includes a lay-out for• development of the r~esidential <br />pr~oper~ty to the east as well. The r•esidential development to the east <br />includes 15 single-family lots as well as Lots A& 6 which ar~e located <br />on County Road C and being pr•oposed for~ commer~cial development. <br />Boosalis also pr~esented to the Council an elevation and per•spective plan <br />which he explainetl in detail and shows the effect of the commer•cial <br />development along Rice Str•eet on the Townsley pr~oper•ty which is located <br />on Iona Lane. <br />Boosalis r~epor•ted that he has submitted a r•epor~t outlining the negative <br />aspects of Plans B, C and D.
