Fahey intr~oduced the following r~esolution and moved its adoption: <br />CUP (Cont.) <br />RESOLUTION N0. 88-6-231 - CLOSING THE <br />PUBLIC HEARING ON THE BOOSALIS CONDITIONAL <br />USE PERMIT REQUEST <br />The for~egoing r~esolution was duly seconded by Mr•. Blesener•. <br />Ayes (5) Fahey, Blesener~, LaValle, Scalze, Collova. <br />Nays (O). <br />Resolution declar~ed adopted. <br />This r•esolution appear~s in Resolution Book No. 19, Page 234. <br />The City Cler•k suggested that if the Council is willing the concept of <br />the pr•oposal be appr•oved at this time. In the meantime a PUD Agreement <br />would be dr•awn up to cover• the various conditions of appr•oval. <br />Scalze pointed out the necessity for• r•ezoning of back por•tion of the commer•cial <br />pr•oper~ty on County Road C to R-1. Scalze stated that these r•ezonings <br />would have to be par•t of the PUD Agr~eement since the City should handle <br />the entir~e pr•oposal as a package. <br />The City Clerk pointed out that a public hearing was never held to <br />consider~ the r•ezoning of the commer~cial pr•operty on County Road C. <br />Pr•evious r•ezoning hear•ings dealt with only the Rice Str•eet pr~oper•ty. <br />Fahey pointed out that the County Road C r•ezonings would need to be <br />r•eviewed by the Planning Commission. Fahey suggested that a public <br />hear~ing be scheduled to consider the r~ezonings for• the fir•st meeting <br />in July. The Planning Commission is meeting tomor~row evening and can <br />consider• the pr~oposal at that time. <br />Scalze noted that ther•e ar•e 4 commer~cial lots on County Road C and <br />that the City does not want to get into the situation wher•e ther~e <br />i s commer•ci al pr~oper~ty fr~onti ng on a r•esi denti al str~eet. Thus, ther•e <br />is a need to r~ezone the back por•tions of the County Road C commercial <br />pr•oper~ties to R-1. Scalze pointed out that if the commer•cial pr~oper~ties <br />wer•e not rezoned and the City did not allow these pr•oper•ties access to <br />the r•esidential str•eet, they could not be assessed for the cost of <br />impr•oving the str•eet. <br />LaValle asked Mr•. Boosalis his timetable for• constr•uction. <br />Boosalis replied that constr•uction would begin as soon as all the <br />necessary approvals ar~e received. <br />Council discussed the possibility of a special meeting, however~, Fahey <br />noted that Mr. Boosalis needs some time to get pur•chase agr•eements <br />finalized for• some of the pr•oper~ties on County Road C. The City cannot <br />r•ezone any property at P~r. Boosalis's request that he doesn't own. <br />Page -3- <br />
