MINUTES <br />City Council <br />June 8, 1988 <br />Boosalis The City Attor•ney felt at the least Mr•. Boosalis would need an enfor•ceable <br />CUP (Cont.) pur•chase agr~eement on a pr•operty befor•e it could be rezoned. <br />Mr•. Fahey intr~oduced the following r•esolution and moved its adoption: <br />RESOLUTION N0. 88-6-232 - GRANTING PRELIMINARY <br />APPROVAL TO THE REZONING REQUEST AND CONDITIONAL <br />USE PERMIT REQUEST MADE BY MR. NICK 600SALIS FOR <br />HIS RICE AT C CENTER PHASE II WHICH WOULD ALSO <br />REQUIRE PUD AMENDMENT AS OUTLINED IN THE CITY <br />PLANNER'S REPORT DATED MAY 25, 1988 CONDITIONED <br />UPON THE APPLICANT RECEIVING FINAL APPROVAL FOR <br />THE PROPOSED RESIDENTIAL DEVELOPMENT TO THE EAST <br />AS HAS BEEN PRESENTED AT PREVIOUS COUNCIL MEETINGS <br />AND WORKSHOP, AND CONDITIONED UPON THE DEVELOPER <br />PROVIDING A 50 FOOT SETBACK TO THE TIM TOWNSLEY <br />PROPERTY LOCATED ON IONA LANE WITH INSTALLATION <br />OF A FENCE AT THE 25 FOOT POINT OF THAT SETBACK <br />AND WITH TNE REQUIREMENT THAT THE DFVELOPER PLANT <br />12 PINE TREES ALONG THE FENCE LINE (6 TREES ON <br />EITHER SIDE OF THE FENCEI OR SUBJECT TO AM AGREEMENT <br />BETWEEN THE DEVELOPER AND MR. TOWNSLEY FOR PLANTING <br />OF TNE PINE TREES <br />The for•egoing r~esolution was duly seconded by Mr•. Blesener•. <br />Ayes (5) Fahey, Blesener•, Scalze, LaValle, Collova. <br />Nays (0). <br />Resolution declar~ed adopted. <br />This r•esolution appear•s in Resolution Book No. 19, Pages 235 and 236. <br />Boosal i s r•epor~ted that he curr~ently has pur•chase agr•eements on two of <br />the County Road C lots, those being the entr•ance and exit to the pr~oposed <br />r~esidential development. Boosalis r~epor~ted that ther~e is a possibility <br />that he will tie up a thir~d lot. This would leave two commer~cial lots, <br />possibly thr•ee if Boosalis does not tie up an additional lot, on County <br />Road C that ar•e zoned commer~cial whose back half would fr~ont on the <br />pr~oposed residential street. <br />Fahey pointed out that Boosalis only needs contr•ol of the entr~ance and <br />exit to the r•esidential area. <br />Scalze pointed out that the Council would have to initiate a r•ezoning <br />for• the back por•tion of the r~emaining commer~cial lots on County Road <br />C outlining again that the City does not want commer~cial proper~ty <br />fr•onting on residential str•eets. <br />Mr•.
