Steffel <br />and questioned the authority that Steffel has to speak for~ the developer. <br />P9cNabb pointed out that the City's Development Agreement is with Mr. Schr•ier <br />and the City should have a letter from him stating that he will make the <br />improvements. <br />Fahey pointed out that when these concerns wer•e fir•st pr~esented to the <br />Council, the Council passed a resolution withholding occupancy per•mits <br />until the problems were corrected. <br />Collova r•eported that the Quilding Inspector• then met with Mr. Schrier <br />who indicated that the improvements would be made. The retaining wall <br />was repaired and some street r•epair•s were made. Schrier~ indicated to <br />the Building Inspector that landscaping would be completed as well. The <br />Building Inspector then began issuing occupancy permits again. <br />Collova agreed that there was a month of good planting weather• left, and <br />now is the time to get landscaping installed. <br />Collova also repor•ted that the Building Inspector has talked to the builders <br />on the site and informed them that if the impr~ovements are not made, <br />occupancy permits would again be withheld. <br />Scalze suggested that the City obtain a report fr~om the DNR on the retaining <br />wall. <br />McNabb repor•ted that the initial problem with the r•etaining wall has been <br />fixed, however•, pr•operty ar•ound the wall is still eroding. <br />The Council discussed whether or not the City should require the improvements <br />to be 100% completed before occupancy per•mits would be issued once again, <br />or• if the major~ity of the work is completed, permits could be issued <br />assuming that the work would be completed. <br />Residents of the Townhomes urged the Council to withhold occupancy per•mits <br />until the wor•k is 100% completed, pointing out Mr•. Schrier's failur~e to <br />complete these items in the past. <br />One resident reported that he has pr•oblems with his home and cannot get <br />Mr. Schrier to even retur~n his calls. This resident also reported that <br />it is his understanding that the City gr~anted Schrier per~mission to move <br />some of the r•equir•ed par~king for the development. The r•esident asked <br />where this ~ar•king was being moved to. <br />Fahey replied that City staff, the Building Inspector or City Planner~, <br />may have allowed the r~elocation of a parking area, and Fahey suggested <br />that the resident contact either of these two individuals for the <br />information. <br />The r~esident asked what the landscaping will look like, pointing out <br />Page -4- <br />
