MINUTES <br />City Council <br />September 28, 1988 <br />Ramsey The City Engineer reported that he has been attending a series of ineetings <br />County of the Ramsey County Soil Conser•vation Commission which is in the process <br />Soil of developing an ordinance which will be required of ev ery City to adopt <br />Conservation for governing of soil erosion. <br />Commission <br /> The City Engineer r•eported that he wil l submit a draft copy of the proposed <br />Agenda ord inance to the City Council when it is available. <br />Addi ti on <br />Spooner The City Attorney reported that he is still awaiting word from the Examiner <br />Park of Titles' office regar~ding the Spooner Par•k property. The Attor•ney <br />stated that, hopefully, the City can close on the property some time in <br />Agenda October, but he d.oes not have a definite that the closing can take place <br />Item No. 12 on at this time. <br />Gardner• The City Attorney presented for approva1 the proposed Development Agreement <br />Bros. with Gardner Bros. for their development proposed on County Road D. <br />Development <br />Agreement Mr•. LaValle introduced the following r•esolution and moved its adoption: <br />Agenda RESOLUTION N0. 88-9-412 - AUTHORIZING THE <br />Item No. 12 MAYOR AND CITY CLERK TO SIGN THE GARDNER BROS. <br />DEVELOPMENT AGREEMENT ON BEHALF OF THE CITY AS <br />PRESENTED BY THE CITY ATTORNEY <br />The foregoing resolution was duly seconded by Mr. Blesener. <br />Ayes (5) LaValle, Blesener, Fahey, Collova, Scalze. <br />Nays (0). <br />Resolution declared adopted. <br />This resolution appears in Resolution Book No. 20, Page 427. <br />AIC The City Attorney repor•ted that there is an effor~t to close on the AIC <br />Corporation Corpor~ation property as soon as possible. However, the seller~ is requesting <br />Property that the City pr•eclude any constr~uction or improvement on the property <br />prior to the last payment being made. <br />Agenda <br />Addition Scalze r•epor•ted that the Par•k Commission had hoped to commence grading of <br />the proper•ty next spring. <br />The City Attorney reported that the City could agr•ee to indemnify AIC <br />Corporation for• any liens against the property pr•ior to final payment. <br />If that is acceptable to AIC Cor•poration, then there would be no need <br />to r•estrict improvements to the property. <br />Council felt the Attor•ney's recommendation for indemnification of AIC <br />Corporation was the position the City should ta!<e. <br />The Attorney reported that he will present this to AIC Cor•por~ation, and <br />will attempt to get the purchased closed. The Attorney r~eported that he <br />will check with the City Cler~k on availability of funds for the purchase. <br />Page -16- <br />
