MINUTES <br />City Council <br />September 28, 1988 <br />Variance Fahey opened the Public Hearing on the request of Midwest Spring for <br />Request a rear yard setback variance of three feet so that they can add onto <br />Midwest their~ building and maintain the existing building setback line. <br />Spring <br />Fahey r•eported that the Plannin,q Commission has recommended appr~oval <br />Agenda of the variance. Fahey also reviewed the Planner's report on this <br />Item No. 6 variance request which states that while the request does not comply <br />with the strict intent of a variance, the existing non-conformity will <br />be maintained. <br />Scalze pointed out that the request is consistent with what the City <br />did for• the Saxon Lanes building addition, wher•e a non-confor~ming setback <br />was allowed to be extended. <br />There was no one present fr•om the general public wishing to comment on <br />this matter. <br />Mrs. Scalze introduced the following resolution and moved its adoption: <br />RESOLUTION N0. 88-9-403 - CLOSING THE PUBLIC <br />HEARING ON THE VARIANCE REQUEST FOR P9IDlJEST <br />SPRING <br />The foregoing resolution was duly seconded by Mr. Blesener <br />Ayes (5) Scalze, Blesener•, Fahey, Collova, LaValle. <br />Nays (0). <br />Resolution declared adopted. <br />This resolution appear•s in Resolution 6ook No. 20, Page 417. <br />P1r. Blesener introduced the following r•esolution and moved its adoption: <br />RESOLUTION N0. 88-9-404 - APPROVING THE REAR <br />YARD VARIANCE OF 3 FEET REQUESTED BY MIDWEST <br />SPRING SINCE THE VARIANCE WILL BE A CONTINUATION <br />OF AN EXISTING BUILDING LINE AND IS SIMILAR TO <br />THE VARIANCE THAT WAS APPROVED FOR SAXON LANES <br />AND POINTIN6 OUT THAT ALL OTHER ASPECTS OF THE <br />BUILDING ADDITION MEET CITY CODE REQUIREMENTS <br />The foregoing resolution was duly seconded by Mr•.
