rniNUrEs <br />City Council <br />October 12, 1988 <br />Countr~y Dr. and asked who would pay the road assessments against his pr•operty if <br />Relocation Country Drive is not lower•ed. <br />(Cont.) <br />A member of the general public asked how long the City could keep a <br />moratorium on the property. <br />The Mayor replied that as long as the City was making r•easonable progress <br />in its decision-making pr•ocess, the moratorium could remain indefinitely. <br />The City Attorney agreed with the Mayor's reply. <br />Pelstring estimated that if the City proceeds on its existing course, and <br />if by the Spring the property owners wer~e not in discussion with a developer, <br />he anticipated that the Council would abandon the moratorium: <br />Don Gagne, property owner• on Country Dr•ive, stated that he was in favor~ of <br />lower•ing Country Dr•ive and felt that impr•oved visibility to the freeway <br />would make a difference in selling his pr•operty. <br />Pe1string reported that with r~egard to the issue of the sale of the excess <br />soil if Countr~y Dr•~ve were lowered, this would be a negotiating point <br />between the City and a developer and would be addressed in a Development <br />Agr~eement. Pelstring also ~ointed out that people are not aware of <br />this Countr~y Drive proper•ty because there is no visibility to the freeway. <br />However, Pelstring pointed out other developments along 35E with visibility <br />and the easy identification of these sites. <br />Gagne suggested that the Council poll the property owners on Countr~y Drive <br />for their position on the lower•ing of the road. <br />Mark Malsam, 2825 Country Drive, George Zender, 2801 Country Drive, and <br />Chuck Rice, 2805 Country Drive, indicated that they were in favor of the <br />lowering of Countr•y Drive as long as Country Drive was lowered from just <br />nor~th of the Water Works property to South Owasso Blvd. <br />Lachenmeyer suggested that if a development is proposed for the Countr~y <br />Drive property, that the City r•equir•e a good landscaping plan and that <br />that plan be enforced. Lachenmeyer pointed out that the City has not <br />enforced the landscaping plan submitted by Larry Lee for the ber~m <br />adjacent to Yorkton Ridge. <br />Fahey stated that the Counci1 will take note of this as a separ•ate issue. <br />6lesener reported that his biggest concern is the effect of the development <br />on Bur•ke Lane and Yor•kton Ri dge. <br />Scalze pointed out that the Zoning Code contains restrictions and requir~e- <br />ments for where commer•cial property abutts residential with regard to <br />setback and screening. <br />Dlesener pointed out that the concer•ns for landscaping and scr~eening will <br />Page -8- <br />
